Notice of Appointment of Receiver and Manager

Murray Charles Radford, Robin Stanley Thornton, Louise Alison Living, Jocelyn Thelma Wellington, Helen Mary Smith, John Paul Martin and Peter Wall Martin, pursuant to a debenture in their favour bearing date the 10th day of September 1991, hereby gives notice that on the 17th day of July 1992, they appointed John Francis Managh of Wellington, chartered accountant, receiver and manager of the property of Osborne Editions International Limited, under the powers contained in the debenture.

The offices of the receiver and manager are situated at the offices of John F. Managh, Chartered Accountant, Suite Eight, Book House, 86 Boulcott Street, Wellington.

The property in respect of which the receiver and manager has been appointed is all the company’s undertaking and all its assets and effects, whatsoever and wheresoever, both present and future, including its uncalled and unpaid capital of the company.

ANZ Banking Group (New Zealand) Limited (“the debenture holders”), hereby give notice that on the 21st day of July 1992, they appointed Bruce McCallum and David Ross Petterson, both of Wellington, chartered accountants, jointly and severally to be receivers and managers of all the undertaking property and assets charged by the debenture dated the 27th day of August 1990, given by the above-named companies in favour of the debenture holders.

Pursuant to Section 346 (1) of the Companies Act 1955

The National Bank of New Zealand Limited, with reference to Apollo Homes Limited, hereby gives notice that on the 20th day of July 1992, the bank appointed Peter Ross McLean and Stuart Raymond Cann, chartered accountants, Beattie Rickman, corner of Bryce and Anglesea Streets, Hamilton, jointly and severally as receivers and managers of the property of this company under the powers contained in an instrument dated the 28th day of November 1991.

The receivers and managers have been appointed in respect of all the company’s undertaking and all its real and personal property and all its assets and effects, whatsoever and wheresoever, both present and future, including its uncalled and unpaid capital.

Appointment of Receiver and Manager

Alderton & Kingston Nominees Limited, a duly incorporated company at Auckland (hereinafter referred to as “the mortgagee”), being the registered holder of a debenture issued upon the above company bearing date the 19th day of October 1990, given to secure the principal sum of twenty two thousand dollars ($22,000.00) and interest thereon in pursuance of the power conferred upon the mortgagee by clauses 18 (a), 18 (b), 18 (e), and 19 endorsed on the said debenture, hereby appoints Susan Mary Kingston of Auckland, solicitor, to be receiver and manager of the premises charged by the debenture upon the terms and with and subject to the powers and provisions in the conditions endorsed on the said debenture contained.

And the mortgagee also appoints the said Susan Mary Kingston, to be its true and lawful substitute to execute in its name any conveyance, transfer, assignment or other instruments and to deliver any such or deeds and to effect any registration and to do all such other things as may be necessary to vest any property sold by the said receiver and manager as such receiver and manager in the purchasers thereof.
