Amending a Declaration and Setting Land Apart for Education Purposes in the Auckland City

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland:

(a) Pursuant to section 55, declares the notice dated 13 July 1973 and published in Gazette, 2 August 1973, No. 72, page 1457, declaring land taken for a State primary school and for teachers residences to be amended by omitting the land ninthly described in the Schedule therein and substituting the land described in the Schedule hereto; and

(b) Pursuant to section 52, declares the land described in the Schedule to be set apart subject to the fencing covenant contained in memorandum of transfer 148530 for education purposes.

Land and a Right of Way Easement Over Land Acquired for Soil Conservation and River Control Purposes in Matamata-Piako District

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Hamilton, declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto, is hereby acquired for soil conservation and river control purposes, the right of way easement described in the Second Schedule hereto (being appurtenant to the land contained in Gazette notice H. 893876, South Auckland Land Registry), is hereby acquired for soil conservation and river control purposes over the land described in the Third Schedule hereto; and further declares the said land and easement described in the First and Second Schedules hereto shall vest in The Waikato Regional Council on the date of publication in the Gazette.

Second Schedule

South Auckland Land District

The rights and powers implied and attaching to a right of way as set out in the Seventh Schedule of the Land Transfer Act 1952, as if the same were fully set out herein provided that:

1. The parties agreed that The Waikato Regional Council will maintain and keep in good repair the said easement to the standard sufficient in the opinion of The Waikato Regional Council to enable the owner to satisfactorily carry out his normal farming business, provided that such maintenance is not attributable to the neglect or default of the owner, his servants or invitees.

2. The owner will give The Waikato Regional Council prompt notice in writing of any defect or want or repair to the said easement and that the council shall not be liable for any deterioration or damage unless in receipt of such notice and the council shall within reasonable time thereafter to its satisfaction remedy such defect.

3. The council agrees that no livestock will be driven, transported or pastured along the right of way easement from Andrews Road to the stopbank.
