Commencement

This order shall come into force on the date that it is signed by the Governor-General in Council.

Schedule

(a) All that area of foreshore commencing at the northernmost point on the eastern side of Coopers Beach and extending northwards to the western side of Coopers Beach as shown on plan MD 16134, deposited in the office of the Secretary for Transport at Wellington.

(b) All that area of foreshore commencing at a point at high water mark opposite the longitudinal station site in Cable Bay and extending northwards to the western end of Cable Bay Beach as shown on plan MD 16134, deposited in the office of the Secretary for Transport at Wellington.

(c) All that area of foreshore commencing at the easternmost point of Taipa Beach and extending northwards to the northernmost point of the western side of Taipa Beach as shown on plan MD 16134, deposited in the office of the Secretary for Transport at Wellington.

Harbour Boards Dry Land Endowment Revesting Act 1991

Notice of Approval for Land to be Sold, Otherwise Disposed of or Modified Pursuant to Section 5 and Section 6 of the Harbour Boards Dry Land Endowment Revesting Act 1991

Pursuant to section 5 and section 6 of the Harbour Boards Dry Land Endowment Revesting Act 1991, I, Denis William Anson Marshall, Minister of Conservation, hereby approve the sale, lease, other disposition or modification of the following parcels of land currently vested in the Northland Regional Council and the Whangarei District Council:

All that land described in Part A of the Schedule to the Harbour Boards Dry Land Endowment Revesting Act 1991 and more particularly described as “Whangarei Harbour Lands”—

(a) Containing 38.4451 hectares, more or less, and being all the land comprised and described in certificate of title, Volume 80, folio 128, Auckland Registry but excluding a marginal strip of not less than 20m as defined in section 2 of the Conservation Act 1987;

(b) Containing 40.9053 hectares, more or less, and being all the land comprised and described in certificate of title, Volume 117, folio 222, Auckland Registry but excluding a marginal strip of not less than 20m as defined in section 2 of the Conservation Act 1987;

(c) Containing 18.6155 hectares, more or less, and being all the land comprised and described in certificate of title, Volume 80, folio 132, Auckland Registry but excluding a marginal strip of not less than 20m as defined in section 2 of the Conservation Act 1987;

(d) Containing 5513 square metres, more or less, and being all the land comprised and described in certificate of title No. 438/945, North Auckland Registry but excluding a marginal strip of not less than 20m as defined in section 2 of the Conservation Act 1987;

(e) Described in the Third Schedule to the Whangarei Harbour Board Vesting and Empowering Act 1962 but excluding a marginal strip of not less than 20m as defined in section 2 of the Conservation Act 1987;

(f) Described in the Second Schedule to the Whangarei Harbour Act but excluding a marginal strip of not less than 20m as defined in section 2 of the Conservation Act 1987.

In terms of section 5 (2) (c) of the Harbour Boards Dry Land Endowment Revesting Act 1991, the approval shall take effect on the 24th day of January 1992.

Reserves Act 1977

Revocation of the Reservation Over a Reserve

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Conservator for the Auckland Conservancy, Department of Conservation, hereby revokes the reservation as a road reserve over the land described in the Schedule hereto and further, declares that the said land may be disposed of by The Rodney District Council at current market value, the proceeds from any such sale to be paid into the council’s reserves account, such moneys to be used and applied in or towards the improvement of other reserves under the control of the council, or in or towards the purchase of other land for reserves.

Change of Classification of a Reserve

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Conservator for the Auckland Conservancy, Department of Conservation, hereby changes the classification of reserve, described in the Schedule hereto, from a reserve for local purpose (site for a kindergarten) to a reserve for local purpose (community education), subject to the provisions of the said Act.
