Additional Land Acquired for Bledisloe School, City of Napier

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares that, an agreement to that effect having been entered into, the land described in the First Schedule is acquired for a public school and shall vest in the Crown on the date of publication in the Gazette. The land is acquired subject to an easement in gross to drain water reserved in favour of The Napier City Council (called “the grantee”) upon the terms and conditions as set out in the Second Schedule.

Drainage Easement

First the unrestricted right to drain and discharge water (whether rain, tempest, spring soakage or seepage water) in any quantities under the land by means of piped drains.

Secondly the unrestricted right for the purposes of the easement:

(a) To use any lines of pipes already laid along the stipulated course or any pipe or pipes in replacement or in substitution for all or any of those pipes.

(b) Where no such line of pipes exists to lay place and maintain or to have laid placed and maintained under the land, a line of pipes of the sufficient internal diameter and of suitable material for the purpose.

Thirdly in order to construct or maintain the efficiency of any such pipeline, the full free uninterrupted and unrestricted right liberty and privilege for the grantee its tenants servants agents and workmen with any tools implements to enter upon the land (by such route as is reasonable in the circumstances) and to remain there for any reasonable time for the purpose of laying inspecting cleansing repairing maintaining and renewing
