Land Set Apart for Road at Marshall’s Bridge, State Highway 5, Hawke’s Bay District

Pursuant to section 52 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares the land now held for a quarry, described in the Schedule to be set apart for road, which pursuant to section 60 (1) of the Transit New Zealand Act 1989, shall form part of State Highway 5.

Easement Over Land Acquired for Water Supply Purposes at Takapau in Hawke’s Bay.

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares that an agreement to that effect having been entered into the following easement is acquired (for the purposes of a research station, pursuant to the Agriculture and Fisheries Act 1953), over the land described in the First Schedule to be forever appurtenant to the land described in the Second Schedule. The easement shall vest in the Crown on the date of publication in the Gazette.

The right to draw and convey water from the well shown on S.O. Plan 10214 by means of a pump installed in a pumphouse and a pipeline of a diameter not greater than 75 mm and buried at a depth of not less than 450 mm across and through that part of the land described in the Schedule.

There shall be implied in the foregoing easement the rights and powers (mutatis mutandis) set out in the Seventh Schedule to the Land Transfer Act 1952.
