Fisheries Act 1983

Fisheries (Foveaux Strait Dredge Oyster Fishery Suspension) Notice (No. 3) 1991, No. 5082

Pursuant to section 47 (4) of the Fisheries Act 1983, the Minister of Fisheries (acting on the recommendation of the Director-General of Agriculture and Fisheries, and after informing the Fisheries Authority) hereby gives the following notice:

  1. Title and commencement—(1) This notice may be cited as the Fisheries (Foveaux Strait Dredge Oyster Fishery Suspension) Notice (No 3) 1991.

(2) This notice shall come into effect on the 30th day of May 1991.

  1. Interpretation—In this notice:

(a) the term “Foveaux Strait Dredge Oyster fishery” means the oyster fishery in Foveaux Strait as defined and declared to be a controlled fishery in the Controlled Fisheries (Foveaux Strait Dredge Oyster Fishery) Notice 1979*.

(b) any reference to licences means licences granted by the Fisheries Authority pursuant to section 33 of the Fisheries Act 1983 in respect of the Foveaux Strait Dredge Oyster fishery.

  1. Extension of suspension—(1) The restriction on all licences imposed by the Fisheries (Foveaux Strait Dredge Oyster Fishery) Notice 1991, No. 5069, dated 25 February 1991 (New Zealand Gazette, 29 February 1991, No. 32, page 683) is hereby extended until the 27th day of August 1991.

(2) The restrictions on all licences imposed by the Fisheries (Foveaux Strait Dredge Oyster Fishery) Notice (No. 2) 1991, No. 5072, dated 24 March 1991 (New Zealand Gazette, 11 April 1991, No. 55, page 1177) is hereby extended until the 31st day of August 1991.\n
4. Purpose—The continued closure of the western and central beds of the Foveaux Strait Dredge Oyster fishery is necessary to minimise the possibility of the oyster infection, Bonamia, being spread by oyster dredges from highly infected areas of the fishery to areas of the fishery that are not infected or which are least infected.
