Notice of Application for Approval of Scheme
Under Part III and IV of the Charitable Trusts Act 1957

Notice is hereby given that Ronald Stewart Scott of Christchurch, company director, David Russell Aickin of Christchurch, medical practitioner, Dennis Geoffrey Bonham of Auckland, medical practitioner, Patricia Marie Buckfield of Wellington, medical practitioner, Georgina Catriona Pamela Augusta Wallace of Auckland, District Court Judge, Bruce Laird of New Plymouth, chemist, Ralph von Kohon of Wellington, company director, John Wilfred Wright of Invercargill, real estate salesman, Alastair James Haslam of Hamilton, medical practitioner and Frederick John Hill of Christchurch, chartered accountant, as present trustees under at deed of trust dated the 25th day of August 1977, have filed in the office of the High Court at Christchurch an application for approval of a scheme varying the terms of the trust under which funds are held under a trust deed now known as The Foundation For the Newborn to be held on perpetual trusts for the purposes of the promotion and organisation in New Zealand of research into all those factors during pregnancy and the neo-natal period which might influence or affect human development and the publication to the best effect of knowledge acquired by such research.

Under the proposed amendment of this scheme the present rules governing the administration of the trust deed are to be amended as follows:

  1. Rule 9 which provides that “a retiring trustee shall be eligible for re-appointment provided that a trustee may not hold office for more than 2 consecutive terms” is to be amended by the deletion of the words “provided that a trustee may not hold office for more than 2 consecutive terms” and;

  2. Rule 11 (1) (c) which provides that “one trustee shall be the immediate past president of the National Association of Round Tables in New Zealand who shall hold the appointment of trustee during this term of office as immediate national past president of the National Association of Round Tables in New Zealand, or his nominee, who shall hold the appointment of trustee during the national past president’s term of office”.

Copies of the scheme and the report of the Attorney-General thereon may be inspected free of charge at the office of the Registrar of the High Court at Christchurch or at the office of the secretary of the Foundation for the Newborn, care of Messrs Peat Marwick, Chartered Accountants, Worcester Street, Christchurch. The application has been set down for hearing in the High Court at Christchurch on the 28th day of June 1991 at 10 o’clock in the forenoon.

Any person desiring to oppose the scheme is hereby required to give notice of his or her intention to do so to the Registrar of the High Court at Christchurch and to the secretary of the Foundation of the Newborn at Peat Marwick, Chartered Accountants, Christchurch and the Attorney-General not less than 7 clear days before the aforementioned date.

Notice of Dissolution of Partnership

The partners of Colonic Clinic 1990 hereby give notice according to clause 5.03 of the partnership deed that Alison Irwin is to retire from the partnership on the 10th day of May 1991. The partnership will terminate as at this date.

Ruth Kay intends to continue to operate the clinic at the same address.
