Declaring Land Set Apart and Land Acquired for the Dunedin-Milton Motorway, Land Set Apart for Road, Airspace Acquired for the Dunedin-Milton Motorway, Airspace Acquired for Railway Purposes and Airspace Set Apart for a Pedestrian Accessway

Pursuant to the Public Works Act 1981 and to a delegation from the Minister of Lands, the Manager (Lands and Property), Department of Survey and Land Information, Dunedin declares:

1. Pursuant to section 52 the land described in the First Schedule hereto to be set apart for the Dunedin-Milton Motorway and the land described in the Second Schedule hereto to be set apart for railway purposes.

2. Pursuant to sections 116 (1) and 117 (3) the road described in the Third Schedule hereto to be stopped and added to the adjoining Dunedin-Milton Motorway and the road described in the Fourth Schedule hereto to be stopped and added to the adjoining land held for railway purposes.

3. Pursuant to section 114 the land described in the Fifth Schedule hereto to be road and vested in the Dunedin City Council.

4. Pursuant to sections 20 and 31 agreements to that effect having been entered into the airspace described in the Sixth Schedule hereto is hereby acquired for the Dunedin-Milton Motorway and shall vest in the Crown on the 18th day of April 1991, and the airspace described in the Seventh Schedule hereto is hereby acquired for railway purposes and shall vest in the Crown on the 18th day of April 1991.

5. Pursuant to sections 31 and 52 the airspace described in the Eighth Schedule hereto to be set apart for a pedestrian accessway.

6. Pursuant to section 20, an agreement to that effect having been entered into, the land described in the Ninth Schedule hereto is hereby acquired for the Dunedin-Milton Motorway and shall vest in the Crown on the 18th day of April 1991.
