Road Realignment in Franklin District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager of the Department of Survey and Land Information, Hamilton:

(a) Pursuant to section 114 declares the land described in the First Schedule hereto to be road and vested in the Franklin District Council.

(b) Pursuant to sections 116 and 177, declares the pieces of road described in the Second Schedule hereto to be stopped and that:

(i) Area “B”, now known as Section 1, S.O. 58397, shall be amalgamated with the land in certificate of title, Volume 1288, folio 3, subject to memorandum of mortgage H.958854.4, and together with a water easement appurtenant thereto created by Transfer 266102, South Auckland Land Registry.

(ii) Area “C”, now known as Section 2, S.O. 58397, shall be amalgamated with the land in certificate of title, Volume 1261, folio 23, subject to memorandum of mortgage H.904760, and together with a water easement appurtenant thereto created by Transfer 266102, South Auckland Land Registry.
