Explanatory Note

This note is not part of the notice, but is intended to indicate its general effect.

This notice amends, by substituting an amended schedule, the final determination in relation to plasterboard from Thailand which was made by the Minister of Commerce on 21 December 1989 and published in the Gazette of 11 January 1990 (as amended by notice in the Gazette of 8 March 1990 entitled 'Final Determination: Dumping Investigation in Respect of Plasterboard from Thailand, Amendment No. 1'). The substitution is made as a result of a reassessment of anti dumping duty carried out pursuant to section 14 (3A) of the Dumping and Countervailing Duties Act 1988. The amended duty applicable to the imported plasterboard is to be calculated by comparing the actual export price with a non-injurious import price level, rather than the previous method of levying a flat rate of duty.

Pursuant to regulation 4 (4) of the Telecommunications (International Services) Regulations 1989, I, Patrick Gerard McCabe, Senior Advisor, Telecommunications and Postal Policy, Ministry of Commerce, acting under delegated authority, hereby give the following notice.

Notice

  1. Short title—This notice may be cited as the Telecommunications (International Services) Regulations (Television New Zealand Limited) Notice 1991.

  2. Television New Zealand Limited a registered operator—It is hereby declared that Television New Zealand Limited was registered as a registered operator for the purposes of the Telecommunications (International Services) Regulations 1989 on 5 April 1991.

Fair Trading Act 1986

Notice Prohibiting Supply of Disappearing Ink, Fade-Away Ink and Similar Fluids

Pursuant to section 31 (3) of the Fair Trading Act 1986, I, the Honourable Katherine Victoria O’Regan, the Minister of Consumer Affairs, by this notice, which shall come into force the day after the date of its publication in the Gazette, prohibit indefinitely the supply of the goods specified in the Schedule to this notice.

Schedule

(a) Plastic or other containers of liquid described as 'Disappearing Ink';

(b) Plastic or other containers of liquid described as 'Fade-Away Ink';

(c) Any other plastic or other container of liquid having a pH less than pH3 or greater than pH10 and which is intended for squirting by children during play.

Explanatory Note

This note is not part of the notice but is intended to indicate its general effect.

This notice prohibits indefinitely the supply of certain liquids intended for squirting by children during play. The notice applies to liquids known as 'Disappearing Ink', 'Fade-Away Ink' and to any other liquid having a pH less than pH3 or greater than pH10 and which is intended for squirting by children during play.

These fluids were declared by the Unsafe Goods (Disappearing Ink and Fade-Away Ink) Notice 1989* to be unsafe goods under section 31 of the Fair Trading Act 1986. By virtue of section 31 (2) of that Act that notice expired on 12 November 1990.

Section 31 (3) of the Fair Trading Act 1986 authorises the Minister of Consumer Affairs, if 18 months has elapsed since goods were declared to be unsafe goods and if no product safety standard has been declared in respect of those goods under section 29 of that Act, to prohibit the sale of the goods indefinitely or for a specified period.

It is an offence under the Fair Trading Act 1986 to supply, or offer to supply, or advertise to supply, goods the supply of which is prohibited under that Act.

Section 33 of that Act also prohibits the importation of such goods into New Zealand.

Closure of Meremere School

Pursuant to section 154 of the Education Act 1989 (as inserted by section 14 of the Education Amendment Act 1989), I hereby declare that Meremere School will close on 15 April 1991 and cease to be established under that Act.

Pursuant to section 36 of the Private Schools Conditional Integration Act 1975, the Senior Manager National Operations, acting on authority delegated by the Minister of Education, hereby gives notice approving an increase in attendance dues at the following schools:

  • St Joseph’s School, Feilding.
  • St Mary’s School, Foxton.
