Notice of Resolution for Voluntary Winding Up

In the matter of the Incorporated Societies Act 1908, and in the matter of The Midland Club (Incorporated) 1902/4: Notice is hereby given that by resolution of members dated on the 20th day of March 1991, it was passed:

“That the Midland Club Incorporated be wound up voluntarily under section 24 of the Incorporated Societies Act 1908.

“That Graeme Norman Davey, chartered accountant, be appointed liquidator and that he proceed with the winding up under the rules governing a voluntary winding up of a company under the Companies Act 1955, and distribute the surplus in accordance with rule 46 of the club.”

Note: The society has ceased activity and a declaration of solvency has been filed with the Registrar of Incorporated Societies.

Notice of Instrument of Dissolution

Notice is hereby given that by virtue of an instrument of dissolution dated the 18th day of March 1991 and filed in the office of the District Registrar of Industrial and Provident Societies at Christchurch, the registry of the above-named society will be terminated on the expiry of 3 months from the date of the New Zealand Gazette bearing this notice unless any member or other person interested in or having any claim on the funds of the society, commences proceedings to set aside the dissolution of the society.

Such proceedings must be commenced in the District Court in or near the locality in which the registered office of the above-mentioned society is situated and notice of any such proceedings must be forwarded to the District Registrar referred to above, not less than 7 days prior to the commencement of proceedings.

The Southland Flood Relief Committee Empowering Act 1991

Notice of Intention to Apply for Leave to Introduce a Private Bill

Take notice that the Southland Flood Relief Committee intends to apply for leave to introduce a Private Bill to be known as “The Southland Flood Relief Committee Empowering Act 1991”.

Objects of the Bill are to discharge the committee from administration of moneys held in trust for the charitable purpose of providing relief to persons suffering financial hardship by loss or damage from floods which occurred in Southland in January of 1984; and to appoint trustees to administer the unexpected balance of the fund for the relief of persons who suffer subsequent financial hardship by loss or damage by recurring flooding.

Upon the grounds that extensive flooding occurred in Southland in January of 1984. The Government appointed a committee to administer funds provided for the relief of persons suffering financial hardship due to loss or damage as a result of that flooding. A portion of the fund was subsidised by the Government. Payments have been made from the fund and accounts for the fund have been audited. There is an unexpected balance remaining and it is inexpedient for the committee to limit payments made from the fund to those cases relating to the January 1984 floods. Properties in the city of Invercargill and in the urban and rural parts of the district of Southland have suffered flood damage subsequent to January 1984. The committee wishes to disburse the balance of the fund for the relief of persons who have suffered a recurrence of flooding. It is desirable for that purpose to release the committee from the administration of the fund and to vest its administration in the persons from time to time holding office as the mayor of the Invercargill City and respectively the mayors of the Southland District and the Gore District, as if the funds were held in a charitable trust pursuant to the Charitable Trusts Act 1957. The objects of the Act cannot be achieved otherwise than by legislation.

Inspection of the Bill may be at the office of the District Court at Invercargill during normal office hours, without fee.
