Declaring Land to be Road and Road Stopped at Horahora Road, Far North District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, declares:

(a) Pursuant to section 114, the land described in the First Schedule to be road which shall vest in The Far North District Council, and

(b) Pursuant to section 116, the portion of road described in the Second Schedule to be stopped.

Easement Acquired for Greenmeadows to Awatoto Sewer, City of Napier

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares that, an agreement to that effect having been entered into, following sewage easements are acquired as easements in gross and shall vest in The Napier City Council (called the grantee) on the date of publication of this notice in the Gazette.

The full and unrestricted right to convey sewage over those parts of the land described in the Schedule marked “A” and “B” on S.O. 9748, together with the full and unrestricted right for the grantee:

(a) To lay, place and maintain a line of pipes under the surface of those parts of the said land marked “A” and “B” on S.O. 9748, together with the right to use any existing line of pipes already laid under the said land.

(b) To enter upon the said land together with its servants, agents, contractors and workmen for the purposes of laying, inspecting, cleaning, repairing, maintaining and renewing the said line of pipes or any part thereof and for any such purpose to take on to the land such tools, implements, machinery, vehicles or equipment that may be necessary and to remain on the said land for such reasonable period of time as may be necessary and to open up the soil of the said land to such an extent that may be necessary and reasonable in that regard subject to the condition that as little disturbance as possible shall be caused to the surface of the said land and that the surface thereof shall be restored as nearly as possible to its original condition.

(c) There shall be implied in the foregoing easements in gross the rights and powers (mutatis mutandis) set out in the Seventh Schedule of the Land Transfer Act 1952.
