Charitable Trust Act Notices

Notice of Application for Approval of a Scheme Under Part III of the Charitable Trusts Act 1957

Notice is hereby given that the Public Trustee as trustee of the Will of Daniel Kennedy, late of Dannevirke, retired farmer, deceased, has filed in the High Court at Palmerston North, an application for approval of a scheme. The proposed scheme would allow for a widening of the existing charitable purposes for which the estate of the deceased is at present held. Under the proposed scheme the estate of the deceased would in summary be held for the following purposes:

  1. The maintenance of the Roman Catholic Parish School at Dannevirke.

  2. The provision of financial assistance towards teaching aids required in connection with the school.

  3. Financial assistance for the following—the benefit of pupils at the school who need such assistance, children from the Dannevirke Parish who need such assistance to attend a Catholic secondary school or a school providing special education, educational requirements for the educational instruction of children of the Dannevirke Parish or adults from the parish taking courses at the school or elsewhere in adult education.

  4. For the advancement of education including the acquisition of land or buildings in the areas served by the Dannevirke Parish.

  5. Subject to the preceding purposes:
    (a) (In respect of income only) for the advancement of education elsewhere in the Diocese of Palmerston North.
    (b) (In respect of capital only) for the acquisition of lands for the advancement of education in the diocese. The expenditure of such capital would be protected by a written formula.

Copies of the scheme and the report on it by the Attorney-General may be inspected free of charge at the office of the Registrar of the High Court at Palmerston North, or at the offices of Jacobs Florentine and Partners, Solicitors, Ninth Floor, National Mutual Centre, corner of The Square and Fitzherbert Avenue, Palmerston North. The application has been set down for hearing in the High Court at Palmerston North on 15 March 1991. Any person wanting to oppose the scheme is required to give written notice of his or her intention to do so to the Registrar of the High Court at Palmerston North, and to the Public Trust Office at Palmerston North, and to the Attorney-General, care of the Crown Law Office, P.O. Box 5012, Wellington, not less than 7 clear days before the above hearing date.

Public Notice

Pursuant to Section 36 of the Charitable Trusts Act 1957

Douglas Flanank Stewart of Alexandra, real estate salesman, is the trustee of the estate of Raymond Armstrong of Wanaka, deceased, who died in 1986.

After payment of accounts, bequests and legacies, a credit of approximately $166,000 remains in the estate.

The residue of R. Armstrong’s estate was left to D. F. Stewart as trustee to distribute amongst such charitable organisations in New Zealand as D. F. Stewart in his absolute discretion shall think fit.

D. F. Stewart has now made application to the High Court at Dunedin for approval of a scheme to distribute and administer the residue of the estate of Raymond Armstrong on the following terms:

  1. Name of Fund: Elsie and Ray Armstrong Charitable Trust.

  2. Aims: For the purpose of providing assistance and relief to the sick, frail and disadvantaged persons (and any other charitable purposes beneficial to the community) who reside in the Wanaka Ward of the Queenstown-Lakes District Council.

  3. Trustees of Fund: A board of trustees to comprise 5 persons; 2 appointed by the Wanaka Rotary Club; 2 appointed by the Wanaka and Districts Lions Club; and Douglas Flanank Stewart.

  4. Powers of Trustees:
    (i) To invest the fund in accordance with the terms of the Trustee Act 1956, subject to the proviso that at least 40 percent of the fund be invested in the Wanaka Ward of the Queenstown-Lakes District Council.
    (ii) To administer the fund and make distributions as they think fit, subject to the proposed rules of the trust which are contained in the scheme.

  5. Report of the Attorney-General: Pursuant to section 35 of the Charitable Trusts Act 1957, a copy of the scheme is required to be laid before the Attorney-General. This has been done and a copy of the report of the Attorney-General is attached to the scheme.

  6. Other Details:
    (i) A copy of the scheme and report of the Attorney-General may be inspected at the office of the Registrar of the High Court at Dunedin.
