Pursuant to section 8 of the Local Authority Reorganisation (Property Transfers) Act 1990, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

Order

1. Title and Commencement—(1) This order may be cited as The Local Government (Raglan County (1989) Charitable Trust Property) Reorganisation Order 1991.

(2) This order shall come into force on the 28th day after the date of its notification in the Gazette.

2. Vesting of Property—(1) This clause applies to the sum of $100,000 which the former Raglan County Council endowed in the trustees of the Raglan County (1989) Charitable Trust, created by deed dated the 31st day of October 1989, and to any property substituted therefor or acquired by the trustees therewith, together with all income earned thereon from the date of creation of the trust until the date of final disbursement of the said sum in accordance with this order.

(2) The property to which this clause applies is hereby vested, on the coming into force of this order, in the local authorities named in the Schedule to this order, and in the proportions specified in that Schedule, freed of all trusts and encumbrances.

(3) The trustees of the Raglan County (1989) Charitable Trust shall forthwith take such steps as are necessary to transfer the said property to the local authorities named in the Schedule to this order.

Whereas—

(a) Section 101H of the Local Government Act 1974 requires that a council shall in the year before a triennial general election determine by resolution, not later than the 31st day of August, the membership and the basis of election of the council; and

(b) Section 23 of the Local Government Amendment Act 1991 provides that notwithstanding anything in section 101H of the Local Government Act 1974, a council may, before the 1st day of August 1991, resolve not to undertake, before the triennial general election of the council to be held in 1992, a review of its membership and the basis on which it is elected; and
