Local Government Act 1974

Resolution Definition of Boundaries of the St Lukes Regional Road Between Duncan McLean Link and Great North Road

At the council meeting held on the 16th day of September 1991, in pursuance of the powers vested in it by section 363 (1) (b) of the Local Government Act 1974 and any and every other power enabling it in that behalf, The Auckland Regional Council resolved:

Firstly:

That the boundaries of the St Lukes Regional Road between Duncan McLean Link and Great North Road in the City of Auckland being roads, streets or parts thereof and other lands hereto formerly declared by resolution of The Auckland Regional Council to be regional road be and are hereby defined as the outer limits of the lands more particularly described in the First Schedule hereto.

Secondly:

That the declaration of regional road formerly established by resolution of The Auckland Regional Council over roads, streets or parts thereof and other lands described in the Second Schedule hereto is limited in its application to the air space from above, and including the surface of the said roads, streets or parts thereof and other lands and excludes the land, airspace below the road and the entire bridge structure whether above or below the surface of the road.

First Schedule

All those roads, streets or parts thereof and other lands situated in Auckland City in the North Auckland Registration District shown stippled on the Regional Council Drawing 720 303-06B. The said roads, streets or parts thereof and other lands are shown in detail on the said drawing but a general description is as follows:
