Charitable Trusts Act Notices

Application for Order to Vary Trust
In the matter of the estate of Elizabeth Forrester, late of Oamaru, married woman (deceased):

The above-named died at Oamaru on the 17th day of July 1940. Her will provided (inter alia) that certain money be held in trust by her trustee (now) AMP Perpetual Trustee Company N.Z. Limited and the income used to provide a holiday rest for married women and/or widows in straitened circumstances who have been mothers of children or are mothers or expectant mothers resident in the Borough of Oamaru or Country of Waitaki, with a limit of $40.00 per person paid in any 1 year.

The trustee has applied to the High Court at Timaru under M. No. 43/91 for orders varying the terms of the will. Such proceeding will come on for hearing in the High Court at Timaru on Monday, the 9th day of December 1991 at 10 o’clock in the forenoon.

The scheme proposes that the limit of $40.00 per annum per person be increased to not more than 10 percent per annum per person of the net annual income from the trust in any 1 year and that the trustee be given power to capitalise any income not distributed over any 1 year including accumulated income currently on hand.
