Notice of Application for Approval of Scheme Under Part III, Charitable Trusts Act 1957

M. No. 448/91

Notice is hereby given that Terence Charles Brandon as trustee to the will of Edith Esther Nixon, widow, late of Wellington, having the terms of the will of the above-named Edith Esther Nixon.

Under the will, among other provisions, 2 equal one-fifth shares of the residuary estate are to be held for the Wellington Presbyterian Social Service Association Incorporated to be applied equally for the general purposes of the Kilmarnock Home for the Aged and the Children’s Home at Berhampore.

Under the scheme the trustee seeks a direction that the payment of 2 equal one-fifth shares be made to the Presbyterian Support Services Central to be applied equally for the general purposes of the Kilmarnock Home for the Aged and for the support and benefit of children in need of care and protection in the Wellington region.

Copies of the scheme and the report of the Attorney-General thereon may be inspected free of charge at the office of the Registrar of the High Court at Wellington or at the offices of the solicitor for the trustee being Brandons, Braemar Building, 32 The Terrace, P.O. Box 36, Wellington.

The application is set down for hearing in the High Court at Wellington at 10 a.m. on the 4th day of December 1991.

Any person desiring to oppose the scheme is hereby required to give notice in writing to the Registrar of the High Court at Wellington and the Attorney-General and the trustee whose address for service is Brandons, Braemar Building, 32 The Terrace, P.O. Box 36, Wellington not less than 7 clear days before the hearing date on the 4th day of December 1991.
