Notice Under the Joint Family Homes Act 1964

Notice is hereby given that Jon Kwiat of Dunedin, carpenter and Glenys Margaret Kwiat of Dunedin, nurse aide, have by application 788441 applied under the Joint Family Homes Act 1964 to register as a joint family home the land situated at 75 Forfar Street, Dunedin, containing 613 square metres, more or less, being Lot 67, Block III, D.P. 3813 and being part Sections 8 and 9, Block VI, Town District and being all certificate of title. Volume 9C, folio 180 (Otago Registry) and that the land will be registered accordingly unless a caveat forbidding the granting of the application is lodged with me under the Act at the District Land Registry Office Dunedin before 21 December 1991 by some person claiming either to be a creditor of the applicant or to have some estate or interest in the said land.

Charitable Trusts Act Notices

In the matter of the Judicature Act 1908 and in the matter of the Charitable Trusts Act 1957 and in the matter of the estate of Leslie Hubert White and in the matter of an application by Peter Wynn-Williams and Peter Robert Raleigh Mulligan of Christchurch, trustees of the trust for the approval of a scheme under section 35 of the said Act—

Applicants:

Notice is given that on Wednesday, the 30th day of October 1991 at 10 o’clock, counsel for the above-named applicants will move the High Court sitting at Christchurch for an order that the scheme dated the 14th day of June 1991, and set out hereunder be approved.

The Scheme

The trustees of the estate of Leslie Hubert White hereby seek an order for the variation of the disposition of capital and income from and for the alteration of the mode of administering the bequest vested in the said trustees for a charitable purpose:

Whereas:

  1. By his will dated the 5th day of May 1965, the late Leslie Hubert White of Hawarden, retired farmer, bequeathed the sum of £5,000 ($10,000) to the trustees to invest the sum upon any of the investments authorised by his will and to pay ½ of the income to the Reverend Mother for the time being of the order conducting the convent at Hawarden for the general purposes of the convent (“the convent bequest”) and to pay the other half to the parish priest for the time being of the Catholic Church at Hawarden or of the parish for the time being serving the Hawarden district for the general purposes of the parish (“the Catholic parish priest bequest”).

  2. On 5 May 1984 the convent at Hawarden operated by the Sisters of the Holy Faith was closed down and has not re-opened. The income derived from that gift has been accumulated since that date and held in trust.

  3. In respect of the convent bequest the trustees are of the opinion that it is impossible to carry out the trust created in favour of the convent at Hawarden but are desirous of applying the bequest both capital and income to the Christchurch convent of the Holy Faith Sisters. In respect of the Catholic parish priest bequest the trustees are of the opinion that it is impracticable or expedient to carry out the testator’s stated purpose owing to the cost of administering the trusts but are desirous of applying both the capital and income to the Catholic parish priest at Hawarden.
