From 1 April 1992, all motor vehicles of the specified class must be fitted with seatbelts which meet the full requirements of the regulations, unless the particular vehicle has been given a permanent exemption.

Any purchaser of a vehicle in the specified class must be advised of the problem with the seatbelts, and of the need to replace them with approved seatbelts.

This temporary exemption does not affect any rights of legal redress. In particular rights under the Motor Vehicle Dealers Act 1975 are not affected, so that for the purposes of section 93 (2) (a) of that Act a Warrant of Fitness issued under this Gazette notice is not a properly issued Warrant of Fitness.

Approval of Revolving/Flashing Amber Lights for Certain Vehicles
Pursuant to regulation 67 (8) of the Traffic Regulations 1976, and a delegation from the Secretary for Transport, I, Carne Maurice Clissold, Controller, Road and Traffic Standards, approve the fitting and use of one revolving or flashing amber light on any fork lift vehicle owned or operated by Wrightson Wools at Invercargill. This approval is given subject to the following conditions:

The vehicle shall be painted a conspicuous colour.

The light shall be used while slow moving or parked and unable to avoid creating a hazard in the performance of its duties.

The light shall be placed in such a position on the vehicle so as to ensure maximum visibility to other road users.
-
Compliance with any conditions imposed by a traffic officer.
-
All other requirements of the Traffic Regulations 1976 and Heavy Motor Vehicle Regulations 1974, including licensing and registration shall be met.

Maximum length of journey and return shall not exceed 5.0 kilometres.

Approval of Motorcycle Safety Helmets
Pursuant to subclause (1) of regulation 88 of the Traffic Regulations 1976* and pursuant to powers delegated to me by section 41 (1) of the State Sector Act 1988, motorcycle safety helmets of the make and type described in the Schedule hereto are hereby approved for the purposes of regulation 31 of the said regulations.

Approval of Brake Testing Instrument
Pursuant to regulation 88 of the Traffic Regulations 1976, the Secretary for Transport, hereby approves, for the purposes of sub-clause (5) of regulation 68 of the Traffic Regulations 1976, the brake testing instrument of the model and type described in the Schedule hereto, subject to the conditions of approval set out in the said Schedule.
Schedule
Hunter B400 series Computerized Plate Brake Tester (two plate configuration), manufactured by the Hunter Engineering Company of the USA.
Conditions of Approval
-
The instrument is to be used only in the two plate configuration with the pedal force sensor.
-
The instrument is to be supplied with an accurate means of computing stopping distances (as required by regulation 68 of the Traffic Regulations 1976) from the indicated readings.
-
The instrument is to have the facility to automatically hold the highest reading of brake efficiency.
-
The supplier shall provide a calibration service that is readily available to the users of this brake testing instrument.
-
Access to the brake test equipment is to be provided as required, for any person so authorised by the Secretary for Transport, for the purpose of checking the accuracy of the brake testing instrument.
