Notice of Application to Vary John Williamson Scholarship Trust

In the High Court of New Zealand, Auckland Registry
Under the Charitable Trusts Act 1957, and in the matter of an application for variation of the John Williamson Scholarship Trust by the Auckland Grammar Schools Board, a body corporate by virtue of the Auckland Grammar School Act 1899, and situated in Auckland—Plaintiff:
Take notice that on Monday, the 10th day of December 1990 at 10 a.m., or so soon thereafter as counsel may be heard the plaintiff will move the Court at Auckland for an order approving the following scheme of variation to the John Williamson Scholarship Trust, namely that:
The capital and income comprising the trust property each be divided among Auckland Grammar School, Auckland Girls’ Grammar School, Epsom Girls’ Grammar School and Mt Albert Grammar School in the following proportions:
- Auckland Grammar School: 35.136%
- Auckland Girls’ Grammar School: 20.517%
- Epsom Girls’ Grammar School: 26.847%
- Mt Albert Grammar School: 17.500%
and that the share of each school be vested in its board of trustees and held on trust solely by each Board subject to the terms of and as if named as trustee in the deed of trust dated the 3rd day of January 1878 in place of the Auckland College and Grammar School Corporation and as if the share of capital vested in each board was capital and the share of income vested in each board was undistributed income.
and that the costs of this application be paid out of the said trust property prior to division as aforesaid.
Any person desiring to oppose the above scheme must give written notice of their intention to do so to each of the following:
(a) The Registrar of the High Court at Auckland; and
(b) The above-named plaintiff at the offices of Bell Gully Buddle Weir, Solicitors, Fifteenth Floor, Auckland Club Tower, 34 Shortland Street, Auckland, the address for service of the above-named plaintiff; and
(c) The Attorney-General
not less than 7 clear days before the 10th day of December 1990.
