3222 NEW ZEALAND GAZETTE No. 151

  1. Restriction on the use of boats and motor vehicles
    (1) No licence holder shall fish from any boat other than a row boat in Lake Thomas;
    (2) No licence holder shall fish from any boat or launch in that part of Lake Waituna which lies on the seaward side of a line between 2 white signposts indicating the restriction sited on directly opposite shores near what is the outlet channel when the channel is open to the sea;
    (3) No licence holder shall fish from any boat, canoe, pontoon, or any form of flotation device in the Mataura River upstream from the Mataura Island bridge;
    (4) No licence holder shall fish for sports fish from any boat in the Upper Waiau River unless the boat is securely anchored or otherwise secured.

  2. Use of nets—(1) No licence holder shall use or cause to be used for taking sports fish a net of any description except a landing net pursuant to clause 5 (2) of this Notice.

  3. Prohibition of possession or control of spear gun
    (1) No licence holder, when taking or attempting to take or when in possession of, any sports fish, shall be in possession of or be in control of, any spear gun or any pointed missile (other than a bullet) which is propelled by means of any mechanical or explosive device.
    (2) Where any licence holder is charged with an offence under subclause (1) of this clause, it shall be a defence to the charge if the defendant proves that the spear gun or pointed missile in the defendant’s possession or under the defendant’s control was not used in the taking of the sports fish.
    (3) In this clause the term “explosive” has the same meaning as in the Explosives Act 1957.

  4. Authorised lures and baits—Subject to subclause (2) of this clause no licence holder shall fish for sports fish with any bait or lure other than artificial frog or mouse, artificial or natural fly, insect, worm, crustacea, mollusc or fish in the following waters:
    (a) The Mataura and Waikaka Rivers and all of their tributaries and all waters of the region that drain to the sea between Fortrose and the Brothers Point;
    (b) Waituna Lagoon and its tributaries.
    (c) The Oreti River and its tributaries downstream of Rocky Point, 1 km west of Mossburn.
    (d) The Waimatuku River and all its tributaries.
    (e) The Aparima River and its tributaries downstream of the Hamilton Burn confluence; the Hamilton Burn downstream of the Otapiri-Mossburn highway.
    (f) All waters draining to the sea between and including the Pourakino River and the Waimeamea River.
    (g) The Lower Waiau River and its tributaries (including the Holly Burn) except from the Waikakahi River above the West Arm—Tawai transmission lines; and the Borland Burn.
    (h) The Mararoa River between the Key Bridge and the Mararoa Weir.
    (2) No licence holder when fishing for sports fish shall be in possession, or be in control of, any lure or bait other than artificial bait in all other waters of the region.
    (3) No licence holder when fishing for sports shall be in possession, or be in control, of any lure or bait other than an artificial fly in the Upukerora and Eglinton Rivers and their tributaries.

  5. Daily limit bag—(1) No licence holder shall on any one day kill or be in possession of more than 6 trout or salmon from one or more of the following waters:
    (a) The mainstem of the Mataura River from the Black Bridge just north of Athol to the sea;
    (b) The mainstem of the Waikaia River downstream of the Waikaia-Piano Flat road bridge near Glarity;
    (c) The mainstem of the Oreti River from Rocky Point to the sea;
    (d) The mainstem of the Aparima River from its confluence with the Hamilton Burn to the sea;
    (e) The mainstem of the Waiau River from the Mararoa Weir to the sea;
    (f) The Makarewa River from its confluence with the Otautapiri Stream to its confluence with the Oreti River;
    (g) The Pourakino River and its tributaries;
    (h) All those waters draining to the sea between Fortrose and The Brothers Point;
    (2) No licence holder shall in any one day kill or be in possession of more than 2 trout or salmon from one or more of the following waters:
    (a) All rivers and streams flowing into Lakes Te Anau, Manapouri, Monowai, Hauroko and Hankinson except for the Upper Waiau and the Mararoa River downstream of the State Highway No. 94 bridge at the Key;
    (b) The Oreti River and tributaries upstream of Rocky Point;
    (c) The Mararoa River and tributaries upstream of the State Highway No. 94 bridge at the Key including the Mavora Lakes and their tributaries;
    (d) The Whitestone River and its tributaries;
    (e) The Waikaka River and its tributaries upstream of the transmission lines;
    (f) The Borland River;
    (g) Lake Thomas;
    (h) The Aparima River and its tributaries upstream of the Hamilton Burn confluence.
    (3) Notwithstanding subclauses (1) and (2) of this clause no licence holder shall on any one day kill or be in possession of more than 4 trout or salmon taken from any other waters of the region.
    (4) No licence holder shall continue to fish for trout or salmon on any day in which he or she has already killed 6 trout or salmon.

  6. Minimum size to be taken—(1) No licence holder shall take or be in possession of any sports fish other than perch (Perca fluviatilis) that does not exceed 25 cm in length.
    (2) Every licence holder taking sports fish (other than perch) which does not exceed 25 cm shall immediately return it with as little injury as possible into the water from which it was taken.

  7. Revocation—The Notice published in the New Zealand Gazette, No. 145 of Thursday, 27 August 1987 on pages 7072–7073 titled District Anglers (Southern Lakes Acclimatisation District) Notice 1987 and the amending notice published in the Gazette No. 157 of 15 September 1988 on page 3631 titled District Anglers (Southern Lakes Acclimatisation District) Notice 1987 Amendment No. 1 and the notice published in the supplement to the Gazette, No. 164 of Thursday, 24 September 1987, on pages 4519–4520 titled District Anglers (Southland Acclimatisation District) Notice 1987, is hereby revoked.
