1990, the Nelson/Marlborough Fish and Game Council hereby gives the following District Anglers Notice.
Notice
1. Title and commencement
This notice may be cited as the District Anglers (Nelson/Marlborough Fish and Game Region) Notice 1990 and shall come into force on the 1st day of October 1990.
2. Interpretation
Words and expressions in this notice which are defined in the Conservation Act 1987, or the Freshwater Fisheries Regulations 1983, shall have the meaning so defined.
3. Open season
(1) Subject to subclause (2) of this clause and to clause 4 of this notice, there shall be an open season for fishing for sports fish from the 1st day of October in any year to the 30th day of April in the following year (both days inclusive).
(2) There shall be an open season for fishing for sports fish from the 1st day of October in any year to the 30th day of September in the following year (both days inclusive) in the following waters (not including tributaries):
(a) Aorere River downstream from the road bridge at Rockville;
(b) Awatere River;
(c) Buller River downstream from the confluence with the Mangles River;
(d) Clarence River downstream from Glen Alton Bridge;
(e) Cobb Reservoir;
(f) Conway River;
(g) Lake Rototi;
(h) Lake Rotoroa;
(i) Lyell Creek (Kaikoura) downstream from State Highway No. 1;
(j) Matakitaki River downstream from the State Highway No. 6 bridge;
(k) Middle Creek downstream from State Highway No. 1;
(l) Motueka River downstream from the road bridge at Ngatimoti;
(m) Oaro River;
(n) Opawa River downstream from State Highway No. 1 bridge;
(o) Pelorus River downstream from its confluence with the Rai River;
(p) Takaka River downstream from its confluence with the Waingaro River;
(q) Taylor River downstream from the New Renwick Road bridge;
(r) Waimea or Wairoa Rivers downstream from the confluence with the Lee River;
(s) Wairau River (including the Diversion) downstream from the Wash Bridge.
(3) A licence holder shall not fish for, or take or attempt to take, any sports fish except during an open season.
4. Closed season
(1) There shall be a closed season for sports fish—
(i) In the Brook Stream located in Nelson City from the 1st day of October in any year to the 30th day of September in the year following (both days inclusive).
(ii) In Lakes Rototi and Rotoroa from the 1st day of May to the 30th day of September in the same year (both days inclusive) in Lakes Rototi and Rotoroa, within a radius of 100 m from the centre of the meeting line with the lakes of those rivers and streams listed:
Lake Rototi—
(a) Travers River
(b) Coldwater Stream
(c) Black Valley Stream
(d) Buller River
Lake Rotoroa—
(a) Sabine River
(b) D'Urville River
(c) Gowan River
(3) There shall be a closed season in respect of the taking of quinnat salmon (Oncorhynchus tshawytscha) in those waters of the Wairau River lying upstream of the Wash Bridge.
5. Authorised tackle
(1) A licence holder shall not fish for or take any sports fish except by using a rod and running line, except that when playing a sports fish, a landing net may be used to secure or land any such fish.
(2) A licence holder shall not use in fishing for, taking or attempting to take sports fish, or have under their control, more than one assembled rod and running line at any one time.
(3) A licence holder shall not fish for sports fish unless they are within 15 metres of the rod being used and have the rod under their own visual observation.
(4) A licence holder in fishing for sports fish shall not fish from any boat or any floating device, in those parts of Lake Rototi and Lake Rotoroa within a radius of 100 m from the centre of the meeting lines of those rivers and streams listed:
Lake Rototi—
(a) Travers River
(b) Coldwater Stream
(c) Black Valley Stream
(d) Buller River
Lake Rotoroa—
(a) Sabine River
(b) D'Urville River
(c) Gowan River
6. Authorised Lures and Baits
(1) A licence holder shall not fish for sports fish with any artificial or natural bait or lure other than fly, insect, worm, crustacea, minnow, or fish (excluding fish ova or any shellfish (Mollusca)).
(2) A licence holder in fishing for sports fish shall not use any lure or bait other than artificial minnow or artificial fly in the following waters and all their tributaries:
(a) Cobb River upstream of its confluence with the Cobb Reservoir;
(b) Goulter River;
(c) Maitai River (except the holders of a junior licence);
(d) Mangles River;
(e) Motupiko River;
(f) Opouri River upstream from and including the Ronga River;
(g) Owen River;
(h) Pearse River;
(i) Riwaka River;
(j) Spring Creek;
(k) Wairau river above State Highway No. 1;
(l) Whakapuaka River.
7. Prohibition on unauthorised fishing equipment, etc.
(1) A licence holder shall not, when fishing for sports fish, use or be in possession of, or be in control of, or convey or cause to be conveyed to the vicinity of any place where that licence holder is fishing or proposes to fish, any prawn, any stroke-hauling or foulhooking gear, or any spear or gaff, any narcotic or poisonous substances or liquid injurious to fish.
