which are defined in the Conservation Act 1987, or the Freshwater Fisheries Regulations 1983, shall have the meaning so defined.

  1. Open season—(1) Subject to subclause (2), (3), and (4) of this clause and clause 4 of this Notice, there shall be an open season for fishing for sports fish from the 1st day of October in any year to the 30th day of April in the following year (both days inclusive).

(2) There shall be an open season for fishing for sports fish from the 1st day of May to the 30th day of June in the same year (both days inclusive) in the following waters:

(i) The Wanganui River and its tributaries from its source to its confluence with the Whakapapa River.
(ii) The Whakapapa River and its tributaries.

(3) There shall be an open season for sports fish from the 1st day of October in any year to the 30th day of September in the following year (both days inclusive) in the following waters:

(i) All lakes within the Waikato Fish and Game Region;
(ii) The Wairoa River;
(iii) The Waihou River and its tributary, the Waimakariri Stream;
(iv) The Maratoto Stream, from the ford on the old Whangamata track (also known locally as the Wires Track) near the junction with the Hamuti Stream, to its confluence with the Waihou River;
(v) The Ohinemuri River, from the concrete bridge (known as the Victoria Street Bridge) on the boundary between Waihi Borough and Ohinemuri County to its confluence with the Waihou River;
(vi) The Waitawheta Stream, from the upstream end of the public vehicle access on Franklin Road (as shown by a signpost) to its confluence with the Ohinemuri River;
(vii) The Waikato River;
(viii) The Waipa River downstream from Toa Bridge (some 16 km upstream from Otorohanga) to its confluence with the Waikato River;
(ix) The Puniu River downstream from the Seafund Road bridge to its confluence with the Waipa River;
(x) The Mangawhio River between the Waikato River and the falls;
(xi) The Marokopa River from its junction with the Mangaotahua Stream to its mouth;
(xii) The Mangaotaki River, from Battle’s Bridge (as shown by a signpost on the Mangaotaki Road (Pio Pio)), to its confluence with the Mokau River;
(xiii) The Wanganui River, downstream from its confluence with the Whakapapa River.

(4) The following lakes:
(i) Lake Kuwakatai;
(ii) Lake Kereta;
(iii) Lake Okaihau;
(iv) Lake Pupuke;
(v) Smales Quarry Lake;
(vi) Lake Puketi;
(vii) The Mangatawhiri River from the bridge on State Highway 2, to its confluence with the Waikato River;
(viii) The Whangamarino River;
(ix) Quarry Road Dam Ardmore;
(x) Papakura City Water Supply Dam;
(xi) The Hikutaia Cut;
(xii) Lake Tomarata;
(xiii) Lake Rotoroa (Hamilton Lake);
(xiv) Lake Hakanoa;
(xv) Any other pond or lake contained within any freehold land title.

(3) No licence holder shall, in fishing for, taking or attempting to take, sports fish, or have under their control, more than one assembled rod and running line, except that a licence holder participating in a fishing competition for non-salmonid sports fish in those waters specified in subclause (2) of this clause, may have under his control two assembled rods and running lines, only one of which shall be used for fishing at any one time.

(4) No licence holder shall fish for sports fish unless within 15 metres of the rod being used and has the rod under visual observation, except a licence holder must remain in attendance of the rod and line at all times in the following waters:

(i) The Wanganui River;
(ii) The Whakapapa River and its tributaries.

(5) No licence holder shall cast with any fly line within 50 m of the shore of Hamilton Lake, except within the boundaries of that portion of the shore allocated as a casting range.

(6) No licence holder shall fish for sports fish from any boat or launch in that part of the Waikato River between the upper limits of Lake Karapiro and the tail race of Lake Arapuni, unless such boat or launch is securely anchored.

(7) No licence holder when fishing for sports fish shall use—

(a) More than 2 lures or baits;
(b) Any lead or weight attached below or so as to hang below any lure or bait;
(c) In any water in which only artificial fly is permitted, any lead or weight other than the necessary weight of line, cast and fly, accepting that “artificial fly” includes any lure of feather, fur, wool, or other material of any kind customarily used in the making of artificial flies, but does not include any lure in the tying of which lead or other weight has been incorporated, unless the hook used in that lure does not exceed 20 mm in length (exclusive of the eye) and the gap of the hook does not exceed 7 mm and the hook is not larger than No. 8 (“Redditch” or “old” scale).
(d) any artificial fly having a multiple hook, or a hook which has a greater distance than 14 mm between the point and the nearest part of the shank.
(e) Any bait or lure treated with any medicinal or chemical preparation other than:

(i) In the case of artificial fly, oil used solely to give buoyancy to such flies; and
(ii) In the case of natural baits, a formalin or other preservation preparation;

(f) Any wire, either plain or twisted, or any gimp trace or cast of a greater thickness than 0.82 mm;

  1. Fishing prohibited between certain hours—No licence holder shall take trout during the period between the hours of 12 midnight and 5 a.m. in the following waters,

(i) The Wanganui River.
(ii) The Whakapapa River and its tributaries.

  1. Authorised tackle (1) No licence holder shall fish for, take or attempt to take, any sports fish except by using a rod and running line except a roach pole may be used to fish for and take non-salmonid sports fish.

(2) Notwithstanding subclause (1) of this clause,

(a) When playing a sports fish a landing net may be used to secure or land any such fish;
(b) For keeping alive non-salmonid sports fish, a keep net placed so as to have the entry above the waterline may be used in the following water—
