Amending a Notice Declaring Land to be Road and Road Stopped in the District of Marlborough

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Lands, Nelson, hereby amends the notice dated the 5th day of December 1989, and published in the Gazette of 14 December 1989, No. 221, at page 6281, land declared to be road and road stopped in the District of Marlborough, by:

(a) deleting the paragraph headed “(b)”, and

(b) substituting “(b) Pursuant to section 116 (1), declares the portions of road described in the Second Schedule hereto to be stopped”;

(c) omitting from the Second Schedule thereto “and Amaigamated”.

North Shore City Council

Notice of Intention to Take Land

Notice is hereby given that The North Shore City Council proposes under the provisions of the Public Works Act 1981, to take the fee simple estate in the land described in the Schedule hereto for a road and which is to be used as part of the widening of the Northcote and Taharoto Roads’ intersection.

The taking is considered reasonably necessary in order to complete the alignment of land already taken for the completion of the widening of the Northcote and Taharoto Roads intersection.

A plan showing the land required to be taken is deposited in the public office of The North Shore City Council, Administration Building, The Strand, Takapuna and is there open for inspection.

Any person having an estate or interest in the land may within 20 working days after the date of first publication of this notice send an objection to the Registrar, Planning Tribunal, Tribunals Division, Justice Department, Postal Centre, Wellington. If any objection is made in accordance with this notice, a public hearing will be held unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

334 square metres, more or less, being part of the land at 35 Taharoto Road, Takapuna which is fee simple land containing 2,449 square metres, more or less, being Lot 1 on Deposited Plan 84414 and being part Allotment 72, Parish of Takapuna and being all the land comprised and described in certificate of title 40D/799 (North Auckland Registry), subject to fencing covenant in transfer 143065, restrictive covenant in transfer 6543, and memorandum of mortgage 982468.1 and 8168024.2.
