Fair Trading Act 1986

The Unsafe Goods (Disappearing and Fade-Away Ink) Notice 1989

Pursuant to section 31 of the Fair Trading Act 1986, the Minister of Consumer Affairs gives the following notice.

N O T I C E

  1. Title—This notice may be cited as the Unsafe Goods (Disappearing and Fade-Away Ink) Notice 1989.

  2. Certain liquids intended for use by children during play declared to be unsafe goods—The following goods are hereby declared to be unsafe goods:

    (a) Plastic or other containers of liquid described as “Disappearing Ink”;

    (b) Plastic or other containers of liquid described as “Fade-away Ink”;

    (c) Any other plastic or other container of liquid having a pH less than pH3 or greater than pH10 and intended for squirting by children during play.

Explanatory Note—This note is not part of the notice but is intended to indicate its general effect.

This notice declares certain liquids intended for squirting by children during play to be unsafe goods under section 31 of the Fair Trading Act 1986. The notice applies to liquids known as “Disappearing Ink” and “Fade-away Ink” and to any other liquid having a pH less than pH3 or greater than pH10 and which is intended for squirting by children in play.

Under section 31 (2) of the Act, unless it is sooner revoked, the notice remains in force for a period of 18 months after the date of publication in the Gazette.

It is an offence under the Fair Trading Act 1986 to supply, or offer to supply, or advertise to supply, goods which are declared to be unsafe goods.

Section 33 of that Act prohibits the importation of such goods into New Zealand.
