Wellington Regional Council

Notice of Intention to Take Land

In the matter of the Public Works Act 1981, and in the matter of the Local Government Act 1974:

Notice is hereby given that The Wellington Regional Council duly constituted under the provisions of the Local Government Act 1974, and being a local authority within the meaning of the Public Works Act 1981, proposes under the provisions of the above Act to execute a public work namely Soil Conservation and Rivers Control and for the purposes of such public work the land described in the Schedule hereto is required to be taken for Soil Conservation and Rivers Control purposes.

And notice is hereby further given that the land so required to be taken is shown on a plan lodged at the offices of the Chief Surveyor, Department of Survey and Land Information, Wellington and there numbered Survey Office Plan No. 34587 a copy whereof is exhibited at the offices of the Council at 142-146 Wakefield Street, Wellington and there is available for inspection by all persons without fee during ordinary office hours. All persons who are affected by the execution of the said public work or by the taking of the said land and who have any objection to the execution of the said public work or to the taking of the said land should state their objections in writing and send the same within 40 days from the first publication of this notice to the Registrar of Planning, Tribunals Division, Private Bag, Postal Centre, Wellington. If any objection is received, a public hearing of such objection will, unless the objector otherwise requires, be held and each objector will be advised of the time, date and place thereof.

Schedule

All that parcel of land situated in the City of Lower Hutt contained in Deeds Index 3/16 in the names of Christopher Heath of 36 Cavendish Square in the County of Middlesex, England, surgeon and Wiliam Audrey Peck of 9 Old Square, Lincoln’s Inn in the same county, Barrister at Law, as trustees of the Heath Estate described as follows:

6106 square metres, being parts section 9, Hutt District and also parts of the bed of Okoutu Stream, situate in Block XIV, Belmont Survey District and being the land shown marked “A” “B” “C” and “D” on Survey Office Plan 34587.
