Granting an Easement Over Land at Heathcote

Pursuant to section 48 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Property Officer, Department of Lands, Christchurch, declares that, an agreement to that effect having been entered into, an easement to occupy and use the land described in the First Schedule hereto is hereby granted on the rights and conditions contained in the Second Schedule.

First Schedule

Servient Tenement

6 square metres, being part Lot 35, D.P. 26, as shown marked “A” on S.O. Plan 17956, lodged in the office of the Chief Surveyor at Christchurch.

Second Schedule

Description of Easement

  1. The Port Hills Energy Authority, its servants, agents and workmen (hereinafter referred to as the grantee) have the full, free, uninterrupted and unrestricted right, liberty and privilege from time to time and at all times to use and occupy the land described in the First Schedule hereto to maintain a transformer station as is required for the distribution of electrical energy and to convey electrical energy over the said land, subject to the provisions of section 48 of the Public Works Act 1981.

  2. The grantee will be responsible for all maintenance of the sub-station of the said land and the grantee shall indemnify the Crown for any damage to the land from any cause whatsoever.

  3. The easement for the occupation and use of the land shall cease and determine at such time as the sub-station on the Crown’s land shall be destroyed and/or removed by the grantees or their successors in title.

The registered proprietors of the land described in the Third Schedule hereto (hereinafter referred to as the grantees) have the full, free, uninterrupted and unrestricted right, liberty and privilege from time to time and at all times to occupy the land described in the First Schedule hereto for the life of the encroachment building subject to the provisions of section 48 of the Public Works Act 1981.
