Land Acquired in Hawke’s Bay County
Pursuant to section 20(1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Lands, Napier, declares that, an agreement to that effect having been entered into, the land described in the Schedule is acquired for soil conservation and river control purposes, and shall vest in The Hawke’s Bay Catchment Board from the date of publication in the Gazette.

364 square metres, situated in the Borough of Havelock North, being Lot 1, D.P. 9361, comprising portion of Suburban Section 29, Havelock North. All certificate of title 157/129.

Land Acquired Subject to an Easement for Soil Conservation and River Control Purposes in Thames-Coromandel District
Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Solicitor, Department of Lands, Hamilton, declares that, an agreement to that effect having been entered into, the land described in the First Schedule is hereby acquired for soil conservation and river control purposes, subject to the easement to convey water having been entered in the Second Schedule (to be held appurtenant to the land described in the Third Schedule) over the land described in the Fourth Schedule and further declares that the land in the First Schedule shall vest in the Hauraki Catchment Board on the date of publication hereof in the Gazette.

5.4360 hectares, situated in Block IV, Waihou Survey District, being part Lot 3, D.P. 134 and being part Whakau Block; as shown marked “A” and S.O. Plan 57530, lodged in the office of the Chief Surveyor at Hamilton.

Description of Easement
The right to convey water as set out in paragraphs 2 and 5 of the Seventh Schedule of the Land Transfer Act 1952, as if the same were fully set out herein, provided that:

The Hauraki Catchment Board, a body corporate constituted under the Soil Conservation and Rivers Control Act 1941 (called “the Board”) its assigns and successors in title will maintain and keep in good repair the easement to a standard sufficient in the opinion of the Board to enable the registered proprietors of the land in the Third Schedule (called “the owner”), their assigns and successors in title to satisfactorily carry out their normal farming business. Provided that such maintenance and repair is not attributable to the neglect or default of the owner his servants or invitees.

That the owner will give the Board prompt notice in writing of any defect or want of repair to the easement and that the Board shall not be liable for any deterioration or damage unless in receipt of such notice and the Board shall within reasonable time thereafter to its satisfaction remedy such defect.

69.2998 hectares, situated in Block IV, Waihou Survey District, being part Lot 3, D.P. 134 and being part Whakau Block. All certificate of title No. 26A/1217.
Fourth Schedule

All that piece of land situated in Block IV, Waihou Survey District, being part Lot 3, D.P. 134 and being part Whakau Block; as shown marked “K” on S.O. Plan 57503, lodged in the office of the Chief Surveyor at Hamilton.

New Zealand Railways Corporation Act 1981
Amending a Notice Declaring Land at Pokeno to be Set Apart for Railway Purposes
Pursuant to sections 10 and 30 of the New Zealand Railways Corporation Act 1981 and section 55 of the Public Works Act 1981, the Chief Executive of the New Zealand Railways Corporation hereby amends the notice dated the 29th day of June 1989, published in Gazette, 1989, No. 116, page 2934, declaring land at Pokeno to be set apart for railway purposes by deleting from the legal description of the land firstly described in the Schedule thereto to words “Allots 10, 11, 28, and part 29 of Section 23” and substituting “Allots 10 and 11 of Section 23”.
