Declaration that Land is a Reserve

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Conservator, Department of Conservation, hereby notifies that the following resolution was passed by the Tauranga County Council on the 6th day of June 1989:

"That in exercise of the powers conferred on it by section 14 of the Reserves Act 1977, the Tauranga County Council hereby resolves that the piece of land held by the said council in fee simple and described in the Schedule hereto, shall be, and the same is hereby declared to be a reserve for recreation purposes within the meaning of the said Act."

Public Works Act 1981

Land and Easements in Gross over Land at Clifton Hill Acquired for Waterworks

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, Christchurch, the District Solicitor, Department of Lands, Christchurch, declares that agreements to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for waterworks, the easement to convey water, electric power and telephonic communications and a right of way in gross in perpetuity described in the Second and Third Schedules hereto is hereby acquired over the land described in the Fourth Schedule hereto and the easement to convey water, electric power and telephonic communications in gross in perpetuity described in the Third Schedule hereto is hereby acquired over the land described in the Fifth Schedule hereto and that such land and easement shall vest in the Christchurch City Council on the date of publication of this declaration in the Gazette.

Second Schedule

Description of Right of Way Easement

The full, free, uninterrupted, and unrestricted right, liberty, and privilege for the Christchurch City Council, its servants, agents, workmen, licensees, and invitees (in common with the registered proprietors of the land described in the Fourth Schedule hereto, tenants, and any other person lawfully entitled so to do) from time to time and at all times by day and by night to go pass and repass, with or without horses and domestic animals of any kind and with or without carriages, vehicles, motor vehicles, machinery, and implements of any kind, over and along the land described in the Fourth Schedule hereto.

Third Schedule

Description of Easement to Convey Water, Electric Power and Telephonic Communications

The full, free, uninterrupted, and unrestricted right, liberty, and privilege for the Christchurch City Council its servants, agents, workmen, licensees and invitees (in common with the registered proprietors of the land described in the Fourth and Fifth Schedules hereto, their tenants, and any other person lawfully entitled so to do) from time to time and at all times to take, convey, and lead water, electric power and telephonic communications in a free and unimpeded flow (except when the flow is halted for any reasonable period necessary for essential repairs) and in any quantity, consistent with the rights of other persons having the same or similar rights, from the source of supply or point of entry, as the case may be, and following the stipulated course (where a course is stipulated) across the land described in the Fourth and Fifth Schedules hereto.
