Amending a Notice Declaring Land to be Road and Land Taken in Block V, Waikehe Survey District, Waikehe County

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Manager, Department of Lands, Auckland hereby amends the notice dated the 8th day of August 1986, published in the New Zealand Gazette of 14 August 1986, No. 127 at page 3411, declaring land to be road and land taken in Block V, Waikehe Survey District, Waikehe County pursuant to Part VIII of the Public Works Act 1981, by deleting the whole of paragraph (b) and substituting the following paragraph:

(b) Declares the land described in the Second Schedule hereto to be taken under section 119 (1), and declares that the land firstly described shall, when so taken, be vested in Bevan Homer Pritchard of Auckland, civil engineer, and Unaisi Naioba Pritchard, his wife and incorporated in certificate of title, Volume 433, folio 121, subject to memorandum of mortgage B. 917508.2 and declares that the land secondly described shall, when so taken, be vested in David Lionel Collins of Auckland, naval rating, and Elaine Joy Collins, his wife, and incorporated in certificate of title, Volume 676, folio 451, subject to memorandum of mortgage B. 582022.1 and declares that the land thirdly described shall, when so taken, be vested in Jennifer Ann McDonald of Waiheke, district nurse, and incorporated in certificate of title, Volume 319, folio 306, subject to memorandum of mortgage B. 124641.3.

Revoking a Declaration Acquiring Land for Social Welfare Purposes in the City of Birkenhead

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Manager, Department of Lands at Auckland, hereby revokes the declaration dated the 5th day of August 1987, published in the New Zealand Gazette of 13 August 1987, No. 135, page 3877, declaring land to be acquired for social welfare purposes in the city of Birkenhead pursuant to section 20 of the Public Works Act 1981.

Land and an Easement Over Land Acquired for Social Welfare Purposes in the City of Birkenhead

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Manager, Department of Lands at Auckland:

(a) Pursuant to section 48, declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto and a right of way easement, containing the rights and powers set forth in the first paragraph of the Seventh Schedule to the Land Transfer Act 1952, over the land described in the Second Schedule hereto, appurtenant to the land described in the Third Schedule hereto, are hereby acquired for social welfare purposes and shall vest in the Crown on the 31st day of August 1989, and

(b) Pursuant to section 48 and the aforementioned agreement, a right of way easement containing the rights and powers set forth in the first paragraph of the Seventh Schedule of the Land Transfer Act 1952 is hereby granted to James Patrick Darragh of Auckland, bricklayer and Elizabeth Helen Darragh, his wife and their heirs successors and assigns, over the land described in the Fourth Schedule hereto to be forever appurtenant to the land described in the Fifth Schedule hereto.
