Drainage Easement Acquired for Education Purposes in the Port Chalmers Borough
Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Lands, Dunedin, declares that, an agreement to that effect having been entered into, a drainage easement over the land described in the First Schedule hereto to be held appurtenant to the land described in the Second Schedule hereto, vesting in the Crown the rights and powers contained in the Third Schedule hereto, is hereby acquired for education purposes on the 10th day of August 1989.
First Schedule
Otago Land District—Port Chalmers Borough
All that piece of land containing 105 square metres, being part Section 16, Sawyers Bay Survey District; marked ‘B’ on S.O. Plan 22889, lodged in the office of the Chief Surveyor at Dunedin.
Second Schedule
Otago Land District—Port Chalmers Borough
All that piece of land containing 2095 square metres, being part Section 16, Sawyers Bay Survey District. All Gazette notice No. 719500 (New Zealand Gazette, 8 December 1988, No. 210, page 5289).
Third Schedule

Description of Easement to be Acquired
The terms and conditions relevant to the right to drain water contained and implied in the Seventh Schedule to the Land Transfer Act 1952 except insofar as such terms and conditions are inconsistent with the terms and conditions hereinafter appearing:

The grantor shall not at any time do or suffer any act or thing to be done which will prevent or interfere with the free passage of water through the first land or through the pipes or prevent or interfere with full and free use and enjoyment by the Crown of the rights and privileges hereby granted.

The grantor shall not be permitted to place any buildings or erections on the first described land over the line of the said easement and will not at any time hereafter do or permit or suffer to be done or permitted any act whereby the rights, powers, licences and liberties hereby reserved to the Crown may be interfered with.

All differences and disputes which shall arise between the grantor and the Crown touching or concerning this notice or any act or thing to be done suffered or omitted in pursuance hereof or touching or concerning the construction of these presents shall be referred to arbitration in accordance with the Arbitration Act 1908 or any amendment thereto or re-enactment thereof for the time being in force.

The Crown and her engineers and workmen in the exercise of all or any of the rights hereby granted and in performing all or any of the obligations hereby imposed will cause as little damage as possible to be done to the surface of the first land and will at the cost of the Crown restore the same as nearly as possible to its former condition or state including the reinstatement of any grass trees shrubs etc., which it may have disturbed or interfered with.

The Crown shall at her own cost keep and maintain the pipes in good and serviceable repair and shall not permit the same to fall into disrepair nor do damage of any kind nor become a nuisance by any cause whatsoever.
