Declaring a Right of Way, a Right to Drain Water, a Right to Convey Water and a Right to Convey Electric Power and Telephone Cables Easements Acquired in Rodney County

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Manager, Department of Lands, hereby declares that, an agreement to that effect having been entered into, easements containing rights of way, a right to convey water and a right to drain water and a right to convey electric power cables and telephone cables over the land described in the First Schedule hereto, vesting in the Crown, the rights and powers contained in paragraphs 1, 2, 3 and 5 of the Seventh Schedule of the Land Transfer Act 1952, together with the additional rights and conditions contained in the Second Schedule hereto, such easements to be held appurtenant to the land described in the Third Schedule hereto, are hereby acquired for post office purposes and shall vest in the Crown on the 3rd day of August 1989.

All that piece of land being part Lot 3, coloured blue on D.P. 44059. Part certificate of title, Volume 1861, folio 39, North Auckland Land Registry.

Additional Rights and Conditions

The right to convey Electric Power and Telephone Cables hereby granted shall include the full, free, uninterrupted and unrestricted right, liberty and privilege for Her Majesty the Queen, her tenants, servants, agents and work persons with any tools, implements, machinery, vehicles or equipment of whatsoever nature necessary for the purpose to enter upon the easement area and to remain there for any reasonable time for the purpose of laying, inspecting, cleansing, repairing, maintaining and renewing any cable(s) or any part thereof and opening up the surface of the easement area to such extent as may be necessary and reasonable in that regard subject to the condition that as little disturbance as possible is caused to the surface of the easement area and that the surface is restored as nearly as possible to its original condition and any other damage done by reason of the aforesaid operations is repaired.

Declaring Road to be Stopped in the City of Auckland

Pursuant to the Public Works Act 1981, and a delegation from the Minister of Lands, the Acting District Manager, Department of Lands declares:

(i) Pursuant to section 116, the portions of road described in the Schedule hereto to be stopped.

(ii) Pursuant to section 117 (7), that when the portions of road have been so stopped:

(a) The area firstly described in the said Schedule shall be added to the adjoining land held for motorway comprised in Gazette notice A. 484762, North Auckland Land Registry,

(b) The area secondly described in the said Schedule shall be added to the adjoining land held for motorway purposes comprised in Gazette notice B. 605455, North Auckland Land Registry,

(c) The area fourthly described in the said Schedule shall be added to the adjoining land held for motorway comprised in Gazette notice A. 455626, North Auckland Land Registry.\n
