Termination Notice: Dumping Investigation Aluminium Sheet

Notice was given in the New Zealand Gazette of 13 October 1988 of the initiation by the Comptroller of Customs of an investigation under section 186H of the Customs Act 1966 in respect of a complaint from Alcan (NZ) Ltd. that aluminium sheet exported or intended to be exported to New Zealand from Indonesia was being dumped.

Alcan (NZ) Ltd. had claimed the allegedly dumped product had caused them material injury in the form of loss of profits, loss of market share and staff reductions.

Interested parties were invited to make written submissions to Customs.

Information and evidence was submitted by the complainant, the overseas exporter, the New Zealand importer and their respective agents.

On 5 December 1988 the Minister of Customs granted an extension of the preliminary investigation period to 90 days under the provisions of section 186J (2) of the Customs Act 1966 on the grounds of:

(a) the complexity of the issues presented by the investigation, and

(b) the difficulty in obtaining satisfactory evidence in the investigation.

Section 186J (1) of the Customs Act 1966 and Article 5 (3) of the GATT Anti-Dumping Code require that an investigation be terminated where the Comptroller is satisfied that:

(a) There is insufficient evidence of dumping to justify proceeding with the investigation; or

(b) there is insufficient evidence that material injury to a
