(a) Pursuant to section 20, declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for road and vested in The New Plymouth City Council on the date of publication hereof in the Gazette.
(b) Pursuant to section 114, declares the land described in the Second Schedule hereto to be road and remain vested in The New Plymouth City Council.

63 square metres, being part Lot 1, D.P. 5696; as shown marked “B” on S.O. Plan 12934, lodged in the office of the Chief Surveyor at New Plymouth.

Land Acquired for Akaroa Radio Station
Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Lands, declares that an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired subject to the encumbrance described in the Fourth Schedule hereto; the land described in the Second Schedule hereto is acquired subject to the encumbrances described in the Fourth and Fifth Schedules hereto and the land in the Third Schedule hereto is acquired subject to encumbrances described in the Sixth Schedule hereto; the encumbrances described in the Fifth and Sixth Schedules hereto to be in favour of the land described in the Seventh Schedule hereto; for telecommunication purposes and shall vest in the Crown on the date of publication in the Gazette.

Description of Easement
Subject to water pipeline easement contained in deed No. 111797 (181 D/296).
Fifth Schedule
Description of Easement
The Crown grants Walter Robert Muller of Dunedin, company director and Dawn Lillian Muller, his wife (hereinafter together with their successors in title referred to as the “Owners”), the rights and powers in and attaching to a right of way as set out in the Seventh Schedule of the Land Transfer Act 1962, as if the same were fully set out herein and the following terms and conditions:

The owners shall not be called upon to contribute to the cost of the erection or maintenance of a stockproof fence and gate on the common boundary of the land described in the First Schedule herein and their balance land but this condition shall not enure to the benefit of succeeding owners of the balance of Part Lot 2, D.P. 34799.

The Crown shall ensure that any fencing or structures erected on the land described in the First Schedule hereto shall not obstruct the owners’ use of the right of way for its full width.
Sixth Schedule
Description of Easement
The Crown grants to Walter Robert Muller of Dunedin, company director and Dawn Lillian Muller, his wife (together with their successors in title), the rights and powers implied and attaching to a right to convey water as set out in the Seventh Schedule of the Land Transfer Act 1952, as if the same were fully set out herein.

20.9060 hectares being part Lot 2, D.P. 34799. Balance certificate of title No. 15A/801.
