Vesting of Reserve

Vesting of Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Manager, Wanganui Region hereby vests the reserve, described in the Schedule hereto, in The Wanganui City Council in trust, for the purpose of a local purpose (cemetery) reserve.

8094 square metres, more or less, being Reserve F, Town of Wanganui, situated in Block IX, Westmere Survey District. All certificate of title 26A/788. S.O. Plan 11573L.

Public Works Act 1981

Declaring an Easement to be Acquired Over Land for Soil Conservation and River Control Purposes in Block IV, Te Mata Survey District, Hawke’s Bay County

Pursuant to section 20 of the Public Works Act 1981, the Minister of Lands declares that, an agreement to that effect having been entered into, the following easement in gross is acquired for soil conservation and river control purposes (and may be surrendered at any time by notice in the Gazette) vesting in The Hawke’s Bay Catchment Board (called the grantee) on the 2nd day of June 1988:

(i) a right of way including the full and free right in perpetuity for the grantee and its agents to do the following over the land described in the Schedule (called the land):

(a) to enter the land and to pass and repass at all times with or without machinery or vehicles;

(b) to do all things necessary to maintain the right of way, for the Board’s purposes, in an efficient state;

(c) to prohibit overgrazing of the land and destruction of vegetation by fire or cultivation;

(d) to prohibit the planting of trees or crops (other planting may be undertaken with the approval of the grantee, such approval shall not be unreasonably withheld) on the land;

(e) to prohibit the erection of any building on the land;

(f) to exercise the within rights in a manner reasonably necessary to serve the purpose of the work.
