Electricity Licence and Land Declarations

  1. The Electrical Supply Authority shall comply with the provisions of this licence, the Electricity Act 1968 and all enactments made in amendment of or substitution for that Act, any Electrical Codes of Practice made under that Act, the Electrical Supply Regulations 1974, the Electrical Wiring Regulations 1976 and all regulations made in amendment of or substitution for any of those regulations.

  2. Any notice to be given to the Electrical Supply Authority shall be sufficient if sent by registered post letter to the offices of the Electrical Supply Authority.

  3. Any notice to be given on the part of the Minister of Energy shall be sufficient if given in writing signed by the Minister or by any persons acting under the authority of the Minister.

  4. Any notice to be given to the Minister of Energy shall be sufficient if given in writing to or sent by registered post letter addressed to the Secretary of Energy, Ministry of Energy, Wellington.

  5. This licence shall come into force on the 1st day of April 1985 and shall continue in force for a period of 21 years from that date unless it is sooner lawfully determined in accordance with clauses 7 or 8 hereof.

  6. The Governor-General in Council may pursuant to section 22 of the Electricity Act 1968 cancel this licence if the Electrical Supply Authority is in breach of the provisions contained in clause 2 of these conditions.

  7. This licence may be cancelled by the Minister of Energy at the request of or with the consent of the Electrical Supply Authority.

  8. At the expiry or cancellation of this licence, the Electrical Supply Authority shall as required by notice in writing by the Minister of Energy remove all buildings, poles and other erections and all transmission lines, plant and other machinery and other removable equipment authorised by the licence to be erected, installed or provided and if within 12 months after being so required the Electrical Supply Authority fails or neglects to remove the same, then the same shall, without payment of any compensation vest in and become the property of the Crown and it shall be lawful for any person authorised by the Minister of Energy in that behalf, subject to compliance with section 15A of the Electricity Act 1968 to enter upon any land or premises and take possession of and remove the same or any part thereof.

  9. Nothing contained in the licence, either expressly or by implication shall be deemed to authorise the Electrical Supply Authority to erect, construct or maintain any lines or works except subject to such conditions (not inconsistent with this licence) as may from time to time be lawfully imposed by any local authority within the district of which any such lines or works may be situated.

  10. The systems of supply shall be as described in paragraphs (a), (b), (c), (d), (e), (f) and (j) of regulation 13 of the Electrical Supply Regulations 1984. The system of supply authorised under paragraph (j) aforesaid shall be a single conductor earth-return system and the use thereof shall be subject to such terms and conditions as are from time to time laid down by the Assistant Secretary (Industries and Markets) of the Ministry of Energy at Wellington.

  11. The Electrical Supply Authority shall, 6 months prior to the expiry of the term of this licence provided in clause 6 herein, make written application to the Minister of Energy for the granting of a new licence.

Area of Supply

All that area in the North Auckland Land District bounded by a line commencing at a point on the sea coast at the middle of the mouth of the Mangawai Harbour and proceeding generally south-easterly along the sea coast to the northern side of the Waitemata Harbour; thence westerly along said side and southerly along the eastern side of said Harbour to the middle of the Whau River; thence south-easterly along the middle of said River to and generally southerly along the middle of the Avondale Stream to a point in line with the north-western boundary of Lot 1, D.P. 35330; thence southerly to and along that boundary to and along the south-eastern boundary of the said Lot 1 and that boundary produced to the middle of the Avondale Stream; thence southerly along the middle of the said stream to the northern boundary of Allotment 363, Whau Township South (New Lynn Domain); thence along the northern, eastern (crossing a Public Road) and southern boundaries of said Allotment 363 to its south-western corner; thence southerly along a right line to the north-western corner of Allotment 372, Waikopiro Parish; thence along the north-western and eastern boundaries of the said Allotment 372 to its south-eastern corner; thence westerly along a right line, crossing Canawhit Street, to the junction of the southern side of said street and the eastern side of Portage Road; thence southerly along the said eastern side and its production to the northern side of the Manukau Harbour (at Green Bay), thence generally south-westerly along said side to the northern side of the Manukau Heads, thence northerly along the sea coast to the South Head of the Kaipara Harbour; southerly, westerly and northerly along the shores of said Harbour to the middle of the Oruawharo River; thence north-easterly along the middle of said River, the Topuni River and the Hakaru River to a point in line with the middle of the road that forms the southern boundary of Allotment 193, Oruawharo Parish; thence easterly to and along the middle of said road, south-easterly along the middle of the road that forms the south-western boundaries of Sections 31 and 30, Block IV, Otamatea S.D. the southern boundary of Section 29 IV aforesaid and the south-western boundaries of part Sections 22, 21 and 18, Block IV, Otamatea S.D. and north-easterly and easterly along the middle of the road that forms the south-eastern boundaries of the said part Section 18, Lots 4 and 3, D.P. 42988 and Sections 12, 11 and 10, Block I, Pakiri S.D. to the eastern boundary of said Section 10; thence northerly to and along that boundary and along the southern and eastern boundaries of Section 50, Block I, Pakiri S.D. to the southern side of Games Road; thence easterly along said roadside to a point in line with the eastern boundary of Allotment E78, Mangawhai Parish; thence northerly to and along that boundary to and along the eastern boundary of Section 16, Block I, Pakiri S.D. and the southern boundary of Section 31, Block I aforesaid and the last-mentioned boundary produced along the middle of the Mangawhai Stream; thence northerly along the middle of said stream and north-easterly along the middle of the Mangawhai Harbour to the point of commencement. Including therein Kawau Island, Takangaroa Island, Tiritiri—Matangi Island and Herald Island (including the causeway) and the Rangitoto Beacon.

The area of supply being more particularly shown outlined in black on plan NZE 2145 (Sheets 1 to 14), deposited in the office of the Ministry of Energy at Wellington.
