Soil and Water Protection

  1. No earthmoving machinery is to be operated in any watercourses during mining operations without the prior approval of the inspector of mines.

  2. Where mining operations are taking place the suspended solids concentration of waters downstream shall not as a result of the mining be increased by more than 80 mg per litre measured 100 metres downstream of the point of discharge into any watercourse or such stricter limits as may be imposed by the conditions of any water right issued for this licence.

  3. The damming of any river or stream, the taking, diversion or use of natural water, the discharge of natural water or waste into natural water and the discharge of natural water containing waste onto land or into the ground, shall not occur except in terms of a right or authorisation granted by the chief engineer of the catchment board if authorisation would normally be required.

  4. In all operations that involve a discharge of water, a tailings retention pond shall be operated so as to prevent waste or noxious water from directly or indirectly entering any watercourse.

  5. The licensee shall comply with all or any written notices issued by the chief engineer of the catchment board regulating the disposal of water after use and discharge of materials either directly or indirectly into any rivers, creeks or waterways adjacent to the land included in the licence area.

  6. No crossing, ford, culvert, bridge or other structure shall be formed or built, in, or over any watercourse where it is likely to adversely affect the natural flow of that watercourse or initiate soil or bank erosion without the prior written approval of the inspector of mines after consultation with the catchment board.

  7. On the completion of mining operations all fillings, dumps or other waste materials which may have been placed near watercourses shall be removed or treated in such a manner as to permit unimpeded stream flow so that there is no risk of fill materials, tailings or other debris entering any watercourse.

  8. No vegetation, soil, or debris shall be deposited in watercourses.

  9. Mining operations shall not initiate or accelerate watercourse bank slumping or erosion. Any such damage shall be repaired to the satisfaction of the inspector of mines after consultation with the chief engineer of the catchment board.

  10. Where shafts, holes or excavations are carried out in the bed of any river or lake, the surface is to be reinstated as near as possible to its natural condition.

  11. The natural colour and clarity of waters shall not be changed to any noticeable extent because of silt pollution.

  12. No alteration or diversion is to be made to existing waterways without the prior approval of the Inspector of mines after consultation with the Ministry of Agriculture and Fisheries and the chief engineer of the catchment board.

  13. The discharge of any toxic or noxious substance into any watercourse is prohibited.

Fisheries Protection

  1. The licensee shall take any precautions which may be required by the inspector of mines to prevent damage to any fishery and the licensee shall not interfere with the rights of public to take stocks of fish.

General Conditions

  1. The licensee shall take all necessary precautions to ensure that no fire hazard arises from mining operations.

  2. Interference with livestock is to be kept to a minimum and no mining operations are to be carried out in paddocks being used for lambing without the landowner/occupier’s approval.

  3. At least 24 hours notice shall be given to the landowner/occupier before entering on to the property. All gates shall be left as found at all times unless otherwise requested.

  4. No mining is permitted within a 10 metre radius of any trig station.

Public Liability

  1. The licensee shall, prior to commencing operations, effect public liability insurance for an amount not less than fifty thousand dollars ($50,000).

The indemnity expressed in the insurance policy shall be sufficiently wide in its coverage so as to include claims arising from damage caused by or resulting from fire or explosion and all fire fighting costs resulting from the licensee’s operations in respect of the land.

The licensee shall, if so requested by the inspector of mines, provide the inspector with a copy of the insurance policy and the receipt evidencing payment of the premium in respect of such policy.

All that area of Endowment land being parts Reserve 203, Lots 1, 2, 3, 4, 5, 6, and 7 D.P. 38 (certificate of title 3B/842), situated in Blocks VIII and XI, Walmea Survey District, Westland County.
