Land Declared to be Road and Road Stopped in Waitomo District

Pursuant to Part VIII of the Public Works Act 1981, the Minister of Works and Development:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Waitomo District Council;

(b) Pursuant to sections 116 and 117, declares the portions of road described in the Second, Third, Fourth and Fifth Schedules hereto to be stopped and further declares that the said stopped road:

(i) Described in the Second Schedule hereto, now known as Section 1, S.O. 52168, Section 2, S.O. 52168 and Section 3, S.O. 52168, shall be amalgamated with the land in certificate of title No. 34B/637, South Auckland Land Registry;

(ii) Described in the Third Schedule hereto, now known as Sections 23, 24, 26-32 (inclusive) and 35, Block IX, Otanake Survey District, shall be amalgamated with the land in certificate of title, Volume 1241, folio 12, subject to memorandum of mortgage H. 669893.4, South Auckland Land Registry;

(iii) Described in the Fourth Schedule hereto, now known as Section 25, Block IX, Otanake Survey District, shall be amalgamated with the land in certificate of title, Volume 1097, folio 163, subject to memoranda of mortgage H. 645171.1 and H. 022925.4, South Auckland Land Registry.

(iv) Described in the Fifth Schedule hereto, now known as Sections 36-40 (inclusive), Block IX, Otanake Survey District, shall be amalgamated with the land in certificate of title No. 29D/434, subject to memoranda of mortgage H. 143474.2, H. 741161.2, H. 531356.1 and H. 531356.2, South Auckland Land Registry.
