Land Declared to be Road and Road Stopped in Otorohanga District

Pursuant to Part VIII of the Public Works Act 1981, the Minister of Works and Development:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Otorohanga District Council.

(b) Pursuant to section 116, declares the portion of road described in the Second Schedule hereto to be stopped.

(c) Pursuant to section 117, declares that the said stopped road now known as Section 1, S.O. 56940, shall be amalgamated with the land in certificate of title, Volume 19B, folio 108, subject to statutory land charge S. 303568 and to memorandum of mortgage H. 270687.5, South Auckland Registry.

First Schedule

South Auckland Land District

All that piece of land containing 130 square metres, situated in Block IV, Orahiri Survey District, being part Lot 2, D.P. S. 20834; as shown marked “A” on S.O. Plan 56940, lodged in the office of the Chief Surveyor at Hamilton.

Second Schedule

South Auckland Land District

All that portion of road containing 143 square metres, adjoining Lot 1, D.P. S. 20834; as shown marked “B” on S.O. Plan 56940, lodged in the office of the Chief Surveyor at Hamilton.

Land Declared to be Road and Road Stopped in Blocks VI and VII, Pakaumanu Survey District, Waitomo District

Pursuant to Part VIII of the Public Works Act 1981, the Minister of Works and Development:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Waitomo District Council.

(b) Pursuant to sections 116 and 117, declares the portion of road described in the Second Schedule hereto to be stopped, and further declares the stopped road, now known as Section 1, S.O. Plan 51759, shall be amalgamated with the land in certificate of title No. 13C/205, subject to lease H. 277129, Memoranda of mortgage H. 375076.5, H. 375076.6, H. 375076.10 and land improvement agreement H. 376099, South Auckland Land Registry.

South Auckland Land District

Road Stopped

All that piece of road containing 1400 square metres, situated in Block VII, Pakaumanu Survey District, adjoining or passing through Rangitoto Tuhua 25 Section 5B3 Block; as shown marked “C” on S.O. Plan 51759.

Declaring a Right of Way Easement Acquired Over Land for the Purposes of a Road in the Borough of Green Island.

Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the right of way easement (in gross) described in the Second Schedule hereto subject to the provisions set out in the Third Schedule hereto is hereby acquired over the land described in the First Schedule of the purposes of a road and shall vest in the Crown on the 24th day of March 1988.

Servient Land

All that piece of land containing 247 square metres, being part Lot 1, Deeds Plan 256, being part Section 93, Block V, Lower Kaikorai Survey District; as shown marked “A” on S.O. Plan 22399 lodged in the office of the Chief Surveyor at Dunedin.

Second Schedule

Otago Land District

Description of Easement

The full, free, uninterrupted, and unrestricted right, liberty, and privilege for the Crown, its servants, tenants, agents, workmen, licensees, and invitees (in common with the owner, his tenants, and any other person lawfully entitled so to do) from time to time and at all times by day and by night to go pass and repass, with or without horses and domestic animals of any kind and with or without carriages, vehicles, motor vehicles, machinery, and implements of any kind, over and along the land over which the right of way is granted or created.

Third Schedule

Otago Land District

  1. The Crown shall at its own expenses maintain and keep in good repair the gravel driveway on the servient tenement.

  2. The Crown shall at all times use its best endeavours to keep the easement land clean and tidy and free from all debris, rubbish, noxious weeds and other unsightly offensive or inflammable matter.

  3. The Crown may erect and display suitable signs and do all things necessarily to protect the safety of the public and the property of the owner.
