(c) The stopped road fourthly described in the First Schedule hereto and the land taken secondly described in the Second Schedule hereto (now known as Section 3, S.O. 34242, Block VI, Owhanga Survey District), shall amalgamate with the land in certificate of title 241/150, subject to mortgages 540943.12, 540943.13, 540943.14, 540943.15, 540943.16 and caveat 730553.1.

(d) The stopped road fifthly, sixthly and seventhly described in the First Schedule hereto and the land taken thirdly described in the Second Schedule hereto (now known as Sections 4, 5 and 6 respectively, S.O. 34242, Block VI, Owhanga Survey District), shall be incorporated in Crown Lease No. 882, certificate of title C1/85, held from her Majesty the Queen by Bruce Allen Cottrill of Wanganui, farmer, and Barbara Lynne Cottrill, his wife (undivided one half share) and David Herbert Monk of Pongaroa, farmer and Heather Vivienne Monk, his wife, as tenants in common in equal shares (undivided one half share) subject to mortgages 540943.12, 540943.13, 540943.14, 540943.15, 540943.16 and caveat 730553.1.

Declaring Land and Easement Over Land Acquired for Soil Conservation and River Control Purposes in Block XVI, Heretaunga Survey District, Hawke’s Bay County

Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into—

1. The land described in the First Schedule hereto is acquired for soil conservation and river control purposes and shall vest in The Hawke’s Bay Catchment Board on the 17th day of March 1988.

2. An easement in gross for right of way over the land described in the Second Schedule hereto is acquired for soil conservation and river control purposes (and may be surrendered at any time by notice in the Gazette) vesting in The Hawke’s Bay Catchment Board (called the grantee) on the 17th day of March 1988.

(a) To enter the land and to pass and repass at all times with or without machinery or vehicles; for the purpose of giving the grantee access to the drainage works and to enable it to modify, maintain or reconstruct such works and to do all things necessary to maintain the same in an efficient state;

(b) To prohibit over grazing of the land and destruction of vegetation by fire or cultivation;

(c) To prohibit the planting of trees or crops (other planting may be undertaken with the approval of the grantee; such approval shall not be unreasonably withheld) on the land;

(d) To prohibit the erection of any building on the land; and

(e) To exercise the within rights in a manner reasonably necessary to service the purpose of the work.
