Pursuant to section 42 of the Public Works Act 1981, the Minister of Works and Development declares the land described in the Schedule hereto to be Crown land subject to the Land Act 1948.

Declaring an Interest in Land Acquired for the Purposes of a Road in Block II, Marotiri Survey District, Taupo County

Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into the interest in land described in the Schedule hereto, held from Her Majesty the Queen by John Alister Page Sherriff of Rotorua, stock agent, and Judith Vivian Sherriff, his wife, by virtue of deferred payment licence D.P.F 1848, Register Book No. 23D/420 is hereby acquired for the purposes of a road and shall vest in the Crown on the 14th day of January 1988.

Declaring an Easement Over Land Acquired for Soil Conservation and River Control Purposes in Block IV, Te Mata Survey District, Hawke’s Bay County

Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into the following easement in gross is acquired for soil conservation and river control purposes (and may be surrendered at any time by notice in the Gazette) vesting in the Hawke’s Bay Catchment Board (called the grantee) on the 14th day of January 1988.

(i) A flood detention dam including the full and free right in perpetuity for the grantee and its agents to do the following over the land described in the Schedule (called the land).

(a) To enter the land and to pass and repass at all times with or without machinery or vehicles;

(b) To construct floodbanks, spillway and dam on the land in accordance with the grantee’s construction plan No. 1909–1n and to modify, maintain or reconstruct such works and to do all things necessary to maintain the same in an efficient state;

(c) To prohibit overgrazing of the land and destruction of vegetation by fire or cultivation;

(d) To prohibit the planting of trees or crops (other planting may be undertaken with the approval of the grantee; such approval shall not be unreasonably withheld) on the land;

(e) To prohibit the erection of any building on the land;

(f) To exercise the within rights in a manner reasonably necessary to serve the purpose of the work;

Subject to the cost of the maintenance, repair and renewal of the right of way over the land described in the Schedule and marked R.O.W. on S.O. Plan 9394 shall be borne by and done at the joint expense of the owner of the said land, the grantee and any third party or third parties having the same or similar rights in respect of that right of way.

Road Realignment in the County of Waikohu

Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land firstly, secondly, thirdly, fourthly, fifthly, sixthly, seventhly and eighthly described in the Schedule hereto are hereby acquired for road and pursuant to section 11 (1A) of the National Roads Act 1953 shall form part of the State Highway No. 2, and the land ninthly described in the Schedule hereto is hereby taken for the purposes of a road.
