Land Declared to be Road, and Land Taken in the County of Rangitikei

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Lands, Wellington:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Rangitikei County Council on the 6th day of October 1985.

(b) Declares the land described in the Second Schedule hereto to be taken under section 119 (1) and to be amalgamated with the land in certificate of title, Volume 173, folio 136, subject to memoranda of mortgage 135870.3 and 498142.2.

Land Declared to be Road

All those pieces of land situated in Block V, Taumata Survey District, described as follows:

As shown marked as above mentioned on S.O. Plan 34801, lodged in the office of the Chief Surveyor at Wellington.

All that piece of land containing 2.4150 hectares, situated in Block V, Taumata Survey District, being part Owhaoko D5 No. 4, marked “D” on S.O. Plan 34801, lodged in the office of the Chief Surveyor at Wellington.

Land Acquired in Hawke’s Bay

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Lands declares that, an agreement to that effect having been entered into, the following easements in gross are acquired for soil conservation and river control purposes (and may be surrendered at any time by notice in the Gazette) vesting in The Hawke’s Bay Catchment Board (called the grantee) on the 6th day of October 1988:

(i) A right of way over the land described in the First Schedule hereto, such grant being in accordance with paragraph 1 of the Seventh Schedule of the Land Transfer Act 1952, together with the right of the grantee to prohibit the planting of trees and crops or the erecting of any buildings on the right of way and subject to the grantee being responsible for any maintenance in respect of its activities on the right of way.

(ii) A flood detention dam including the full and free right in perpetuity for the grantee and its agents to do the following over the land described in the Second Schedule (called the land):

(a) To enter the land and to pass and repass at all times with or without machinery or vehicles;

(b) To construct floodbanks, spillway and dam on the land in accordance with the grantee’s construction plan No. 1730 and to modify, maintain or reconstruct such works and to do all things necessary to maintain the same in an efficient state;

(c) To prohibit overgrazing of the land and destruction of vegetation by fire or cultivation;

(d) To prohibit the planting of trees or crops (other planting may be undertaken with the approval of the grantee; such approval shall not be unreasonably withheld) on the land;

(e) To prohibit the erection of any building on the land; and

(f) To exercise the within rights in a manner reasonably necessary to serve the purpose of the work.

Second Schedule

Hawke’s Bay Land District

Flood Detention Dam

All that piece of land situated in Block IV, Te Mata Survey District, being part Lot 3, D.P. 17716; marked “B” on L.T. Plan 20380, lodged in the office of the Chief Surveyor at Napier.
