Classification of Reserve

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Manager hereby classifies the reserve, described in the Schedule hereto, as a local purpose (hall site) reserve, subject to the provisions of the said Act.

Public Works Act 1981

Notice of Intention to Take Land for Soil Conservation and River Control Purposes in Block X, Heretaunga Survey District, Hawke’s Bay County

Notice is given that it is proposed, under the provisions of the Public Works Act 1981, to take the land described in the Schedule for soil conservation and river control purposes, which is to vest in The Hawke’s Bay Catchment Board and to be used for the reconstruction and realignment of the Ngaruroro River stopbank at Fernhill.

The taking is considered reasonably necessary for the proper and safe functioning of the stopbank.

Any person having an estate or interest in the land may within 20 working days after the date of the first publication of this notice send an objection to the Registrar, Planning Tribunal, Tribunals Division, Justice Department, Private Bag, Wellington. If any objection is made in accordance with this notice a public hearing will be held, unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

All those pieces of land situated in Block X, Heretaunga Survey District, described as follows:

The land is situated in Fernhill Village and lies between the stopbank and the Ngaruroro River.

A copy of the plan can be seen at the office of the District Manager, Department of Lands, Napier.

The date of first publication of this notice is the 29th day of September 1988.

Land Acquired for Soil Conservation and River Control Purposes in Tauranga County

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Solicitor of the Department of Lands, Hamilton, declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for soil conservation and river control purposes, and shall vest in The Bay of Plenty Catchment Board on the date of publication hereof in the Gazette.

Road Realignment in Tauranga County

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager of the Department of Lands, Hamilton:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road which shall vest in The Tauranga County Council;

(b) Pursuant to section 116, declares the pieces of road described in the Second Schedule hereto to be stopped;

(c) Declares the land described in the Third Schedule hereto to be taken under section 119 (1);

(d) Pursuant to section 117 (7), declares the area of stopped road firstly described in the Second Schedule hereto to be added to the adjoining land held for electricity works under Gazette notice H. 077244, South Auckland Land Registry;

(e) Pursuant to sections 117 and 119, declares that the area of stopped road secondly described in the Second Schedule hereto and the area of land taken described in the Third Schedule hereto now known together as Section 1, S.O. Plan 56151, shall be amalgamated with the land in certificate of title No. 22C/1424, South Auckland Land Registry;

(f) Pursuant to section 117, declares that the area of stopped road thirdly described in the Second Schedule hereto now known as section 1, S.O. Plan 56433, shall be amalgamated with the land in certificate of title No. 22C/1422, South Auckland Land Registry.
