ORDER IN COUNCIL

His Excellency THE ADMINISTRATOR OF THE GOVERNMENT

IN COUNCIL

Pursuant to section 36 of the Local Government Act 1974, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby makes the following order:

O r d e r

  1. Title and Commencement—(1) This order may be cited as the Taupo County - Taumarunui County Boundary Alteration Order 1988.

(2) This order shall come into force on the day of its making.

  1. Boundaries of Taumarunui County and Taupo County Altered—The boundaries of the district of Taumarunui County and the district of Taupo County are hereby altered by excluding from the district of Taumarunui County and including in the district of Taupo County the area described in the Schedule hereto (hereinafter referred to in this order as “the said area”).

  2. Riding boundaries—The boundary of the Tongariro Riding of Taupo County is hereby altered to include the said area.

  3. Chairman and principal administrative officer—The chairman and principal administrative officer of the Taupo County Council shall have and may exercise the duties, powers, and functions of the chairman and principal administrative officer of the Taumarunui County Council in respect of the said area.

  4. Transfer of responsibilities and other matters—The Taupo County Council in respect of the said area:

(a) Shall have and may exercise and be responsible for all the powers, duties, acts of authority, and functions which were previously exercised, or which would have been so exercised, by the Taumarunui County Council;

(b) Shall have and may exercise and be responsible for all liabilities, obligations, engagements, and contracts which previously were, or which would have been, the responsibility of the Taumarunui County Council;

(c) Shall have and may exercise and be responsible for all actions, suits, and proceedings pending by or against, or which would have been the responsibility of, the Taumarunui County Council;

(d) Shall succeed to the bylaws which are in force and which are applicable to its altered circumstances and, until revoked or altered by the Taupo County Council, every such bylaw shall remain in force in the area in which it was in force immediately before the alteration of boundaries; and every bylaw which cannot be restricted to the said area shall be deemed inapplicable and revoked in respect of the said area by the alteration of boundaries;

(e) Shall succeed to all rates or levies or other money payable to the Taumarunui County Council;

(f) Shall succeed to the valuation rolls, electoral rolls, and rate records in force in the said area, and these shall remain in force until such rolls or records are made by the Taupo County Council, and until that time Part XIV of the Rating Powers Act 1988 shall apply in the said area as if the district in which the said area is included was the district of a special purpose authority and the said area was a constituent district.

  1. Vesting of land—The corporation of the Taupo County Council shall, in respect of the said area, have vested in it, subject to all existing encumbrances, all land in that area vested in the corporation of the Taumarunui County Council.

  2. Title to land—Any reference (express or implied) to:

(a) “The Taumarunui County Council”; or

(b) “The Chairman, Councillors and Inhabitants of the County of Taumarunui”

in any instrument or other document whatsoever, or in any entry or record made on any document whatsoever, or in any entry or record made in any register in relation to any instrument or other document whatsoever, relating to any land vested in the Taupo County Council by clause 6 of this Order, shall, unless the context otherwise requires, be read as a reference to “The Taupo County Council”.

  1. Creditors—Subject to section 37F of the Local Government Act 1974, the rights or interests of creditors of any district affected by this Order shall not be affected.

  2. Apportionment of assets and liabilities—There shall be no apportionment of assets and liabilities including loan liabilities pursuant to clause 2 of this order.

  3. Civil defence—The operative local civil defence plan for the district of Taupo County shall apply to the said area, and shall be the only operative civil defence plan to apply in that area.

Schedule

All that area in the Wellington Land District, Taumarunui County, situated in Blocks V and IX, Pukeiti Survey District, bounded by a line commencing at a point in the middle of the Waihi Stream and proceeding south-westerly along a right line towards Trig Station Tongariro to its intersection with the south-western boundary of Waihi Kakahakahaoro 7; thence north-westerly along that boundary and the south-western boundary of Waihi Kakahakahaoro 6B to the westernmost corner of that section; thence north-easterly along the south-eastern boundaries of Waihi Kakahakahaoro 5, 4B, 4A, 3B2B2A and a right line across State Highway 41 to the south-eastern boundary of part Waihi Kakahakaharoa 3B2 (M.L. 5316); thence north-easterly along that boundary and its production to the middle of the Waihi Stream; thence south-easterly down the middle of that stream to the point of commencement.

Pursuant to section 2 of the Coroners Act 1951, the Right Honourable Sir Ronald Keith Davison, the Administrator of the Government has been pleased to appoint:

Christopher John Harding, barrister and solicitor of Hamilton,

to be a coroner for New Zealand, vice Richard John Webb deceased.
