Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager, Department of Lands declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired, subject to the drainage easement in gross in favour of The Hikurangi Dairy Company Limited, described in the Second Schedule hereto, in connection with a road and shall vest in the Crown on the 22nd day of September 1988.

All that piece of land containing 2.3730 hectares, situated in Block XVI, Hukerenui Survey District, being Allotment 228, Parish of Hikurangi; as shown on S.O. Plan 60352, lodged in the office of the Chief Surveyor at Auckland.

Second Schedule

A drainage easement in gross over part Allotment 228, Parish of Hikurangi as shown marked “D” on S.O. Plan 60352, with the rights set out in the second and fifth paragraphs of the Seventh Schedule to the Land Transfer Act 1952 provided that the word “effluent” shall be substituted for the word “water” wherever it appears.
