Water Recreation Regulations 1979

The Water Recreation (Waikato River, Cambridge to Ngaruawahia) Notice 1988

I, Thomas Edwin Law, Senior Advisory Officer (Harbours Management), pursuant to the Water Recreation Regulations 1979 and in exercise of powers delegated to me pursuant to sections 8 and 9 of the Ministry of Transport Act 1968, hereby give the following notice:

  1. (a) This notice may be cited as the Water Recreation (Waikato River, Cambridge to Ngaruawahia) Notice 1988.

(b) The notice shall come into force 14 days after publication in the New Zealand Gazette, and shall remain in force until revoked by further notice in the Gazette.

  1. Subject to the conditions set forth in the Third Schedule hereto, regulations 7 (1) (a) and (b) and 7 (2) of the Water Recreation Regulations 1979 shall not apply to the area as specified in the First Schedule hereto.

  2. Subject to the conditions set forth in the Third Schedule hereto, regulations 8 (1) (a) and (b) and 8 (2) of the Water Recreation Regulations 1979 shall not apply to the area as specified in the Second Schedule hereto.

  3. The Water Recreation (Waikato River, Cambridge to Ngaruawahia) Notice 1981 is hereby revoked.

First Schedule

All that area of water in the Waikato River extending from the Fergusson Bridge, Cambridge, downstream to where the extension of the northern boundary of Lake Road, Horotiu, crosses the Waikato River, as marked by notice-boards, excepting therefrom that area of water from 600 metres upstream of the Grantham Street (Hamilton) boat ramp to 200 metres downstream of the said ramp, as marked by notice-boards. The area is more particularly shown on plan M.D. 16507, deposited in the office of the Secretary for Transport, Wellington.

Second Schedule

All that area of water in the Waikato River extending from the Fergusson Bridge, Cambridge, downstream to where the extension of the northern boundary of Lake Road, Horotiu, crosses the Waikato River, as marked by notice-boards, excepting therefrom that area of water extending from the extension downstream where the westward extension of Wymar Terrace, Hamilton, crosses the Waikato River, as marked by notice-boards. The area is more particularly shown on plan M.D. 16053, deposited in the office of the Secretary for Transport, Wellington.

Third Schedule

  1. Suitable notices shall be erected at the limits of the areas described in the First and Second Schedules hereto, setting out the extent of the exemptions.

  2. There shall be erected on both banks of the Waikato River at each point described in the First and Second Schedules hereto, a conspicuous marker post painted with 300 mm bright orange and black bands as may be approved by the Regional Nautical Officer, Ministry of Transport, Auckland.

  3. Any person in charge of a vessel when proceeding at a speed greater than 5 knots within the areas described in the foregoing Schedules of this notice shall not approach, pass or carry out any manoeuvres that are likely to threaten the safety of or cause undue annoyance to any other person using the water for fishing, boating, swimming, or other recreational pursuits.

  4. The Collision Regulations Order 1976 must be observed.
