Decision

These five magazines were submitted to the Tribunal at the request of the distributor Gordon & Gotch. Following the original hearing in respect of these publications a majority of three of the members of the Tribunal were prepared to find that the publications Adult Fantasy and Parade were unconditionally indecent. And all members of the Tribunal were prepared to find that the publications Model Celebrities, Glamour Girls and Park Lane should be classified as indecent in the hands of persons under the age of 18 years. A final decision in respect of all publications was deferred however until the outcome of an appeal to the High Court by the Comptroller of Customs in respect of decisions made by the Tribunal relating to Knave and Fiesta magazines had been reached and advised to the Tribunal.

Unfortunately this particular file was overlooked by the Tribunal after the decision of the full court of the High Court was made available to the Tribunal in respect of the Knave and Fiesta appeal thus the reason for the late determination in respect of these particular publications. Those members of the Tribunal who were present at the hearing on 24 October 1986 are now unanimous in their decision that each of these publications should receive a restricted age classification.

The Tribunal has previously expressed its concern and repeats it here that the publications Park Lane, Adult Fantasy and Parade place undue emphasis on the female genitalia with many of the models being posed in what are clearly contrived positions to accentuate the genitalia. The publications Model Celebrities and Glamour Girls consist almost entirely of photographs of naked and semi-naked women but the objectionable concentration on the genitalia is less evident in these particular publications.

As indicated each of these publications is classified as Indecent in the hands of persons under the age of 18 years.
