Notice of Intention to Take Mineral Rights
Notice is hereby given that the Whangarei County Council proposes to take one half share in mineral rights, under section 23 of the Public Works Act 1981. The land is located at the Corbett Road, Hikurangi and more particularly described in the Schedule hereto, although presently owned by I. L. Hickford, the separate half share in mineral rights are vested in the deceased estates of Peter and George Strongman.
The reasons why the Whangarei County Council considers it essential to take the mineral rights are as follows:
(a) the existing public road formation has encroached onto this private land for many years.
(b) road has been maintained from public funds.
(c) the land owner consents to this very minor encroachment.
(d) to allow the present alignment to remain.
Notice is further given that plans showing the said land are deposited at the office of the council situated at Springs Flat, Kamo and may there be inspected without fee by all persons during ordinary office hours.
All persons affected by the taking of these mineral rights and have an objection thereto, must state their objections in writing and send the same to the Secretary, Town & Country Planning Appeal Board, P.O. Box 1224, Wellington North so as to reach him no later than 27 September 1988.
If any objection is received, a public hearing of the same will be held unless the objector otherwise requires, and each objector will be advised of the time and place of the hearing.
