Declaring Easement over Land Acquired for Soil Conservation and River Control Purposes in Block X, Heretaunga Survey District, Hawke’s Bay County

Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the following easement in gross is hereby acquired for soil conservation and river control purposes (and may be surrendered at any time by notice in the Gazette) vesting in the Hawke’s Bay Catchment Board (called the Grantee) on the 28th day of January 1988 the right to construct a river stopbank in accordance with the Grantee’s construction plan No. 1893-C4 including the full and free right in perpetuity for the Grantee and its agents to do the following over the land described in the Schedule (called the land):

(a) to enter the land and to pass and repass at all times with or without machinery or vehicles;

(b) to modify, maintain or reconstruct the stopbank and to do all things necessary to maintain the same in an efficient state;

(c) to prohibit over grazing of the land and destruction of vegetation by fire or cultivation;

(d) to prohibit the planting of trees or crops (other planting may be undertaken with the approval of the Grantee; such approval shall not be unreasonably withheld) on the land;

(e) to prohibit the erection of any building on the land; and

(f) to exercise the within rights in a manner reasonably necessary to serve the purpose of the work.
