Declaration Terminating State of Local Civil Defence Emergency

Pursuant to section 56 of the Civil Defence Act 1983, I, Norman Walter Schultze, hereby terminate the state of local civil defence emergency declared in respect of the Greymouth Borough Civil Defence area on 20 May 1988.

The termination of the local civil defence emergency shall take effect from the time and date of the making of this declaration.

ORDER IN COUNCIL

At Wellington this 7th day of June 1988

Present:
THE RIGHT HON. DAVID LANGE PRESIDING IN COUNCIL

Whereas the Grey County Council (hereinafter referred to as the Council) conducted, on the 11th day of October 1986, a rating poll pursuant to sections 13 and 14 of the Rating Act 1967 on the proposal to change the basis of rating within the Karoro Division of the county from capital value to land value:

And whereas section 16 of the Rating Act 1967 requires that, within 21 days after such a poll has been taken, the Returning Officer shall cause to be published in the Gazette and in one or more newspapers circulating in the district a notice stating the result of the poll:

And whereas the Returning Officer caused a notice stating the result of the poll to be published in the Greymouth Evening Star of the 16th day of October 1986 and in the Gazette of the 20th day of November 1986:

And whereas the notice caused to be published in the Gazette was not published within the time required by section 16 of the Rating Act 1967:

And whereas section 16 of the Rating Act 1967 requires that a copy of the notice of the result of the poll shall, forthwith after the publication thereof, be sent by the Returning Officer to the Valuer-General:

And whereas that copy was sent by the Returning Officer to the Valuer-General on the 20th day of January 1987:

And whereas section 18 of the Rating Act 1967 provides that the date on which a proposal, if carried, shall be implemented shall be the 1st day of April next succeeding the date on which the result of the poll was published:

And whereas the Council implemented the proposal as from the commencement of the 1st day of April 1987 (which was the 1st day of April next succeeding the date on which the result of the poll was published in the Greymouth Evening Star):

Now, therefore, pursuant to section 170 of the Rating Act 1967, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order:

Order

  1. Title and commencement—(1) This order may be cited as the Grey County Council (Rating Validation) Order 1988.

(2) This order shall come into force on the day after the date of its publication in the Gazette.

  1. Validations—(1) The action of the Returning Officer for the district of the Council in publishing in the Gazette of the 20th day of November 1986 the notice of the result of the poll conducted by the Council, on the 11th day of October 1986, on the proposal to change the basis of rating within the Karoro Division of the County from capital value to land value is hereby declared to be and to always have been valid, notwithstanding that that notice was published in the Gazette after the time required by section 16 of the Rating Act 1967.

(2) The action of the Returning Officer for the district of the Council in sending to the Valuer-General on the 20th day of January 1987 a copy of the notice required to be published pursuant to section 16 of the Rating Act 1967 is hereby validated, notwithstanding that the copy of the notice was not sent to the Valuer-General forthwith after the publication of the notice.

(3) The actions of the Council—

(a) In implementing, as from the commencement of the 1st day of April 1987, the proposal to change the basis of rating within the Karoro Division of the county from capital value to land value; and

(b) In levying and collecting rates in the Karoro Division of the county on the basis of land value during the rating year that commenced on the 1st day of April 1987,—

are hereby declared to be and to have always been as valid as they would have been if the notice required to be published had been published in the Gazette within the time required by section 16 of the Rating Act 1967 and if a copy of the notice setting out the result of the poll had been sent by the Returning Officer to the Valuer-General forthwith after the publication of the notice.
